Resolved Question: If I'm on temporary disability due to emergency surgery & my boss fires me, am I entitled to unemployment?

I have been employed by the same company as an office manager for 5 years. It's a very small company consisting of 2 employees. I am in California and did check with the Fair Employment office and learned that if a company has less than 5 employees, they are not required to hold your job while you are out sick or disabled. I went in for emergency hernia surgery on Feb. 13th. I am home recovering as per my doctor's instructions and have applied for temporary disability. However, if my boss does not hold my job for me, would I still be entitled to be eligible for Unemployment Insurance, once I recovered and was able to return to work? Update: To protect myself legally with a paper trail, I've been communicating thru e-mail with my boss on my current medical status. I asked him this morning if he had chosen to hold my job for me. He said he has someone temp filling in till I return. He's very hostile towards me, so I'm relieved yet surprised he said that. I appreciate and value all of your answers. I will take them into consideration because I don't trust this is the end of my plight. Thank you!

My boyfriend has worked as a baggage handler for Delta for 3 years. He started having a sore back about a year ago. He had baggage fall on top of him from the cart they bring it to the plane with, and his supervisor thought it was funny and didn't fill out an accident report. He kept complaining about his back after that, and she told him that it was just sore muscles from the lifting, bending and twisting, and to take some Advil and toughen up. Finally he made an appointment with his doctor, and they found he had a cracked vertebrae and a slipped disc. He had told his manager a week prior that he had an appointment to get his back looked at, and he would be late. He came to work with a doctors note to put him on light duty. It turns out he may need surgery, but when he talked to his manager about workers comp, he was told that he did not qualify because he hadn't filled out an accident report, and that he went to a family doctor instead of a qualifying doctor for the company. He was told yesterday that he will be put on unpaid leave until his back is fixed because the company policy is to only have light duty workers for 90 days. I'm also thinking that without working, he won't have insurance (or any way to afford continuing his current policy). He has coworkers who can vouch that he complained about his back, and they can also vouch that accident reports are very rarely filled out there. Basically they want to see blood before they'll fill one out. He also wanted to fill out an accident report once when he hurt his foot walking on the tarmac to a plane. There was a hole that he stepped into and he complained about his foot to his new supervisor. He also refused to fill out an accident report because he was "just walking, and it was his own fault". We later went to the emergency room to find he had torn all the ligaments in the top and bottom of his foot and was on crutches for 3 weeks. I'm curious if seeking a lawyer is a good idea....or if anybody knows guidelines for temporary disability. We live in Maine. Thanks for any advice or ideas.

Ok am 32 weeks pregnant with my third child, I live in the state of New Jersey and by law am entitled to 12 weeks which are parted as four weeks before due date and six weeks after, which are going to be paid to me by the Temporary Insurance Disability program of the state of New Jersey, but I just found out that you are also entitled to 12 weeks family leave in the state of New Jersey, have in mind this is not maternity leave is call family leave, So does anyone knows if i could take my maternity leave and after those 12 weeks are gone i could get another 12 weeks as family leave with pay?

I work for a company whom after a year offered me health care. Now I'm on temporary disability and paying my own health insurance. Its expensive. My girlfriend is a college professor with a master's degree in Psychology. She was a full time employee at a local college and was recently (2 years ago) dropped to an adjunct because the college did not want to pay health insurance. In my job, i realized that it costs more money to employee 3 part timers without health care than one full time employee who health care options. Now, I don't follow politics alot because I don't have much faith in our government, but I raise a question : Why can't thegovernmentt offer incentives or tax breaks for employers who offer health benefits to their employees? In my opinion this would increase fulll time employment plus help with health care. Ibelievee that many companies would take advantage of this and even seek more 40+ hours in their employees and therefore the employees would make more money, stimulate the economy and the health costs would be less. As stated before, its just curiosity. But am I on to something?

I have a question about temporary disability... I had to have my doctor fill out a health sustaining medication form to keep me on insurance through the state because I am on suboxone for opioid dependence. Along with the form she filled out for me was a disability form and she marked that I was temporarily disabled and was on a treatment plan... I was just informed that I can collect money through the state if a doctor says I am disabled... I just want to ask if anybody has any info or experience with this and what I would need to do to collect money... If you plan on leaving an answer telling me I am an idiot and a loser for getting addicted to pain meds just don't waist your time. I was injured in an accident a while back and needed meds and I did get addicted... I am working with my doctor on a suboxone plan to get me off of them and so far it has been working great. I haven't used any meds in like 6 months.. So please mature answers only.. Thank you in advance for taking the time to read my question!

Do I owe my job the TDI money? Back in October, I was placed on temporary disability insurance because of a work-related incident while waiting for workman's comp to go through. I've been receiving my TDI money. However, because of unforeseen circumstances, I'm going to have to permanently move out of state. I have a workman's comp claim that is pending. If I terminate the pending claim, will there be any legal action? Because I will be leaving the state and quitting my job before returning, will I owe my job any money? What is the worse case scenario? Best case scenario?

I have been diagnosed with Shingles, and in my case this includes debilitating pain. The magnitude of pain medication required for me to function makes it impossible for me to work, or drive, or even stay awake for more than 3 to 4 hours at a time. In addition, I will soon have a rash of blisters which will cause me to be contagious, possibly spreading chicken pox to anyone who has never had it before. I have a 40 hour a week job as a night auditor for a fairly small hotel. I do not have health insurance from them, and I cannot be without my paycheck during this time. My research indicates that I will be communicable for up to 3 weeks, but that this pain my proceed and follow the break of rash for up to a month on both sides. So its possible that I will find myself unable to work for up to 2 months. Does anyone know if there is any way I can get temporary disability benefits to cover for my lost time at work? And if my job will be protected by law if I have to spend that much time away from it?

Okay, so I am in between insurances, due to a layoff. I was laid off due to the number of days I had to take because my disability has gotten worse. I can't use cobra (long story) and I need some type of coverage badly. I used to have Medi-Cal before I got my job in 2007, but was taken off because I made too much. Due to the worsening of my disability, I doubt that I will even be able to ever return to work. So, right now I am in need of medi-cal majorly, because I am on a lot of meds, one of which is Fentanyl patch. I get 10 100mcg patches and 10 50 mcg patches every few weeks. I found out that Kaiser charges $800 for the 10 100 mcg patches and $400 for the 50mcg patches, if uninsured. There is no way I can pay for those even with a job, so now I am in a difficult situation. Is there anyway that Medi-Cal will give me temporary coverage until there decision is made, or is there any sort of insurance I can get on for low income people? I already tried needymeds.org but most take at least a little time to get processed. I only have 5 patches left and if I have no way to get them, I will be thrown into a forced withdrawal; not to mention be left with excruciating pain. Does anyone know if Medi-cal will provide me with immediate temporary coverage?

This summer I switched from full time status to part time status due to family issues, and I have been working for my employer for over two years. I am a very dedicated employee, always working extra hours when I can. However, our short term disability policy is that you have to work 30 or more hours per week. I generally work between 20 and 30, so that would not qualify me. I'm trying to get on state insurance right now, and I've started seeing a therapist, who is sending me to a psychiatrist in 4 weeks, to try and determine what is wrong with me. I think I am bipolor, they think I am depressed or that I have post traumatic stress disorder with problems stemming from my childhood. I don't knwo what the hell is wrong with me, but it's just getting worse and worse and worse everyday, and they won't give me meds until I actually see the psychiatrist. I cannot function at work. I cannot concentrate, focus, i snap at my coworkers, i have to go to the bathroom and let myself cry for 10 minutes and come back in and continue to work. I am not doing as great a job as I used to, obviously. So, my question is, is there anyway I can get some sort of temporary paid time off to cope with this illness that I have? I really feel I'm just going to end up getting myself fired, and how is that really my fault? I cannot control what my brain is doing. it's really really frustrating!!! I live in Connecticut. If anyone has any info for me, please help! thanks. I'm not looking for a handout. I'm not looking to stop working. I'm looking for a little help while I get things into check. It is all coming at me so fast I just need like 2 weeks off to take a break and to focus on therapy and talking and coping. I want to prevent myself from screwing up my job because let's face it, anyone can get my job. unemployment is sky high right now. I'm the last person who would suck off of the goverment tit because I'm too lazy to do anything else. Those programs aren't there to be abused, but there is a reason for them. TEMPORARY help is all I'm looking for. I want to figure things out. I've never dealt with any of this before and I don't want to be misdiagnosed. I want to be able to devote all my time right now to focusing on my mental health. That's the only reason I asked.

Last year I was a temporary employee for a company for 8 months from April through December. The company paid into the CA-SDI fund as if I were a regular employee. This year I've been a consultant from January through the end of July. On August 1st, I had a serious bicycle accident and my primary doctor put me on disability for three months. Am I eligible for CA-SDI insurance because I worked for an employer last year? Looking at the web site, it seemed like I was eligible, but someone at the SDI office said I was defined as a consultant and therfore ineligible. One of the rules for being eligible is that you have to be working or looking for work before being disabled. I am wondering if their definition of working means being a W2 employee. Your advice is greatly appreciated.

I am going to work as long as i can or till the doctor tells me not to anymore because i cant afford to leave early. I already filed for child support and that wont kick in till way after he is born it could take more than 5 months so that wont help, TANF benefits will pay for rent and electric but that will take about a month to process so i cant do that because they cant start that until i have no job and i need help paying my car note, and car insurance. Background, My father in law has been out of work since late may due Pulmonary Fibrosis, a lung condition. He has been placed on the lung transplant list, and the pulmonologist told him not to work. The general practitioners at Allegheny General said he could return to work. He has been following the specialist's advice. He is on temporary disability. He has been working as an injection foamer in a refrigerator factory for 36 years. The chemicals he uses these days supposedly could not cause his illness. But we have no idea about the other compounds he has used over the years. Today they informed him that starting tomorrow he is no longer employed, and does not have any benefits, including his medical insurance. Because he did not come back to work. This factory has no union. Question: I personally think this cannot be legal, since he is under doctor's orders. Any body know what exactly his rights would be in this case. No they are in Jefferson county. When he was really ill they had to send him to AG in order to treat him enough to insure he lived. I would appreciate constructive input please.

I have worked for a MAJOR company for just under a year. Since I started I have dealt with workplace harassment. It started out with a sort of workplace bullying and with each passing day it progressively got worse and worse. I have taken notes from day 1 about the things going on. Besides the obvious third party sexual harassment, work place bullying, and unprofessional behavior there has been several violations of the law and of the company code of conduct. I made several report inside my office to all levels of management; first my immediate supervisor then her supervisor and then her supervisor...nothing was done. Finally I reported it to HR and the next day I received a threat from one of the employees via internet communication (the threat was made during working hours I was off work that day but the employee who threatened me was not). I did a screen print and saved it to a word document (I doubled clicked on my lap top clock to pop up the clock in the screen before I did the screen print to show the time and date of the screen print). I have been in and out of the doctor because of this. My doctor diagnosed me with anxiety and depression as a result of this. My weight has yo-yo'ed, I have constant headaches and nausea, I get shaky, I just burst into tears over the slightest things (I started crying over a Rice Crispy commercial) and I'm not an emotional person at all and no I'm not pregnant. HR refused to relocate me to a different office (there are 16 offices in the county I work in) during the investigation. I told them I feared for my saftey due to the threats and they said they cannot relocate me because if they did it for me they could do it for anyone and as of right now all I have are allegations. I told them I had notes, proof of conversations, proof of the threat; they still said if you don't go to work you will be fired. I talked to my doctor and he agrees my symptoms are due to stress from this whole ongoing harassment and situation. So he put me on temporary disability. Well my last paycheck was only 75% of my normal salary. Turns out my "coding" was changed to part time the day after I reported the harassment and when I called to find out about my pay they also told me "oh also as a part time employee you aren't eligible for short term disability pay". They also told me my manager has to open a claim to get me back pay for the hours I worked and didn't get paid. I asked my manager to open a claim but she didn't and now she is on vacation. All I wanted was to be able to go to work and do my job without being harassed and now all these problems have started...what am I supposed to do? I can't afford an attorney I'm not getting paid at the moment! To summarize: They violated the whistleblower confidentiality They changed me from a full time status to part time status without consent or even notification so they don't have to pay me short term disability They are making me pay out of pocket for my medical bills as apart of my disability claim (they are not allowing me to use my insurance) They are not protecting me under the whistleblower law They aren't paying me for hours worked

Following a long hospitalization that included a coma and temporary paralysis, I lost my job because I ran out of FMLA time. The cause is still sketchy, but based on everything else being ruled out and timing, the doctors' best guess was that I had a rare adverse reaction to a medication I was put on a high dose of a few weeks before. I was in a wheelchair for months, following a walker and now a cane after much physical therapy. Even with insurance, medical bills from both the hospitalization and after completely wiped out all of my savings and investments. Upon release, the doctors said I could not work, but on the disability form, they put an expected recovery date of 11 months. I was there when each doctor filled it out. It was just a hopeful guess, there was no way of knowing for sure. I then found out that the disability has to be projected to either end in your death or last at least 12 months in order to qualify for Disability SSI. I also do not qualify for unemployment because I am "too disabled". I have been back and for on the phone for hours with government officials, lawyers, and non-profit groups, and have been basically been told I am out of luck. It has been 9 months and I am still no where near fit to work, but my doctors' can not change the forms until the original guess is up. I have run out money completely, and have debt from paying these bills, have had to surrender my car, and still have to pay for Cobra, tons of medications and more doctors and tests. I would also love to go back to school to become a therapist to help people like me. As strange as it sounds, I have never been this emotionally stable and content. Does anyone have any ideas or suggestions??

In 1964, despite having just suffered significant injuries in a plan crash, Ted Kennedy stood on the floor of the US Senate and gave an impassioned speech in an effort to convince southern Democrats to end the filibuster of the Civil Rights Act that was later signed into law by President Johnson. In 1965, Ted Kennedy managed the passage of Immigration and Nationality Act, which struck down discriminatory immigration quotas which favored European immigration. Ted Kennedy amended the Voting Rights Act of 1965 to lower voting rights to 18 year olds. This laid the basis for 26th constitutional amendment - lowering the voting age from 21 to age 18. Ted Kennedy helped overhaul the passage of the 1971 National Cancer Act which gave the FDA broad authority to regulate the tobacco industry - also strengthening the National Cancer Institute. Ted Kennedy championed the 1972 Meals on Wheels Act to assist those who cannot prepare meals on their own. Ted Kennedy wrote the Refugee Act of 1980, providing a standard for allowing worldwide refugees into the country on a systematic basis for humanitarian reasons. Ted Kennedy introduced the 1980 Civil Rights for Institutionalized Persons Act which guaranteed civil rights and liberties for those living in government run institutions (the mentally ill, elderly, and incarcerated etc.) In 1985, Ted Kennedy introduced the Anti-Apartheid Act, thereby imposing economic sanctions against the racist South African regime until they reformed. The act banned American investments in South African businesses and SA product imports. It was passed by Congress despite President Reagan's veto. Ted Kennedy co-sponsored the 1997 State Children’s Health Insurance Program (SCHIP) which now covers 10 million, poor uninsured American children. His legislative efforts led to the establishment of the 1997 Amber Alert Emergency System - now a national standard used by state authorities to locate missing/abducted and exploited children in North America. Ted Kennedy sponsored the Pension Protection Act of 2006 - it strengthened the financial condition of pension plans, improved taxpayer protections, and their transparency. Oh yeah, I forgot about the how Teddy pushed through the Federal Election Campaign Act Amendments of 1974 which limited individual donations to political campaigns and set up public financing for presidential elections.

I am a junior college student studying biochemistry, and was diagnosed with ADHD when I was in grade school. I have met up with the disability services office at my college, and they have given me the temporary accommodation of books on audio. It has helped enormously, raising my GPA from a 2.7 to 3.8 over two years. However, the disability services office is now threatening to take away the accommodation unless I get a more recent evaluation for ADHD, which runs about $500. I have researched every option I can think of, including my school's health center and my insurance company, but I just can't find funding to have this done. I'm really pretty desperate for help here. Does anyone know where I could find funding?

My father was diagnosed with DDD about 10 years ago. He has had 3 surgeries and is in need of a forth. However, his doctor doesn't want to do this because he may never walk again. He is 55 years old. He has been on disability for two years and is now being forced into early retirement against his will. Very long story short, he has been seing a pain specialist until recently. He has recently been denied health insurance and is not eligible yet for medicare. I'm not sure why, he just isn't. My mother has the only income in their home right now. My father was taking various medications and wanted to discontine for several reasons. His pain doc put him on some kind of a drip. Well, once the insurance stopped, so did the pain meds. My father is in bad shape and he was actually in tears last night. Just for a temporary solution so my father can maybe sleep at night, I need to know of a legit place to purchase him some GOOD pain medication. I don't have a script and I don't want to have to sign up and pay monthly fees. I've heard of people doing it. I need to know from those who have done it. I know that Governor Corzine recently signed legislation that will provide New Jersey employees with up to six weeks of paid family leave under the state’s temporary disability insurance program. The law goes into effect July 1, 2009. This benefit will be 100% paid by the employee, but when will I get it?

I received a letter from my long term disability insurance company stating they are cutting off my disability benefit for severe bipolar disorder because I am well enough to return to work (their standard is any occupation, but it would be full time work - the policy allows part time work). I have very severe bipolar disorder and have been extremely suicidal and in and out of the hospital over and over for the past 4 years, and have improved about 30% recently- but bipolar does that on its own - it is an intermittent disorder. I am never well enough to work full time or even 20 hours a week - it is very severe bipolar- I have a social worker etc. Bipolar is DEFINED by being intermittent - my case has been unusual in that it has been so chronic. They know I have been very ill back to 1995, when I first went on disability - it is very clear, I will never recover from this illness. I have been hospitalized like 15 times. So does anyone know how long term disability is SUPPOSED to work for severe disabilities that are well proven to have times of temporary remission? It isn't reasonable for them to say I can go back to work when I will only last a couple weeks, then be back in the hospital. I'm sure you fibromyalgia sufferers and back pain folks have been thru this stuff before. Do long term disability companies just do this to people, and try to kick them off, even after 15 years? I'm 19 years old, and have only had one job in my short life. I am about to enter rehab for the first time after being hospitalized in a psychiatric facility 2x this year. I have been diagnosed with bipolar II and anxiety, then re-diagnosed with depression and anxiety. obviously i also have a substance abuse problem. now, my problem is that i only have 2mos work experience and am technically a dependent on my mother's insurance b/c of not currently being mentally stable. god bless the woman for putting me up, but i NEED to get out of this house. (per recommendation of my therapist, and also common sense) the reason being that my step father and brother are also alcoholics, which is a major stressor, as well as being a very easy way to relapse. so, i need to figure a way to get on some sort of temporary government relief, just so i can have enough money for first months rent to go to sober living (and quite possibly a few months after.. until deemed well enough to work)? please, anyone who can help me get this settled, thank you for taking the time. i really want to get better, and i just can't do that here. i go in on monday so i've only got today and tomorrow to get this figured out... the reason i mention only having 2months of work experience is because i have been told it is sometimes based on former salary/wages, and i'm not certain i could qualify for anything due to that.

1. Does anybody out there have links to personal injury attorneys for me in the Dallas area? 2. Has anybody out there (in the Dallas area) suffered from an on-site, work related injury/temporary or permanent disability? (if so, please tell me your story) Long story short. In a menagerie of owners, general contractors, subcontractors, and employees I was injured while performing my job. I worked through the injury (in much pain) in order to complete the project. Yes, the injury was reported to my employer...the subcontractor. He did not suggest, advise, or otherwise seem to terribly concerned about getting me medical attention. Now I know why. He had no Workman's Compensation insurance. Here's the problem: My employer is based out of Colorado. Also my home state. PI attorneys here in CO will not touch my case because the injury occurred across state lines. So, I have 2 options once I can find an attorney in the Dallas area. 1. File a claim/suit against the general contractor. 2. File a claim/suit against the owners of the property. Please help. I'm in constant pain and have not held / cannot hold a job since Nov. 17th, 2008. To add insult to injury, my former employer has not responded to any of my phone calls or emails re: said injury. They jumped her & beat her up, & she told me that the security guards allowed it to happen, even on camera @ the mall, & the cops cursed her out & threatened to put out a warrant for her arrest. They stole the temporary license plate off of her car & ripped up her car insurance papers. I live in TX, & she lives in GA. I'm only going by what she's saying. This situation isn't fair. I had to make it short & sweet, but there's more to the story. She also said they stole her mail box key & broke her computer, & the cops didn't do anything. This is unfair. They're taking advantage of her mental disability. She's a disabled military veteran. They jumped her today @ the mall, & she got banned, & they didn't. If the cops refuse to do anything, how can she stop these people from harassing her? I'm afraid they might kill her. Please help!

Hey you guys, I have a question...I have been on disability for over 2 years now and am waiting for the B.W.C. to figure out how much the settlement is going to be (if I even agree to settle). Since the MRI proved that I was disabled the insurance company wants to settle..You know how it goes. Well they stopped my Temporary Total Compensation because they think I can go back to work (which they've been saying all along) and I have been applying everywhere for a long time now. Even before the recession..My question is when the company that I am applying to looks into the background check, will me being on BWC come up?Because I have applied to easily over 100 jobs since they stopped paying in January and no one has gotten back to me. I asked my doctor and he said he didn't know so let me know..BTW Im in Ohio...and I do have an attorney.it just slips my mind every time I talk to him...Also my attorney asked me in the last week of February if I wanted to settle and seeing as that I'm never gonna get any better I have no choice because physical therapy is not going to help (I have arthritis in my spine and my discs thats only gonna get worse with age according to my doctor) how long does it take for them to offer me a settlement amount...the website for BWC said 30 days but its been over 30 days...and lastly is it a good idea to settle?I'd like to get back to work..They didnt pay me much when I did get paid.But im not sure I can somedays its hard to get out of bed and forget sitting on a chair after an hour my lower back and hips are throbbing...again thank you for ur time... About 3-4 years ago I started feeling a pain in my chest. It feels like a tearing of my muscles from the bone. It is usually on the left side of my sternum (my left). If I do a lot of pushing and pulling or if I do work above my head with my hands in the air it hurts and the more I work like that the more pain I feel. It gets so bad I just have to lay down and just not move. I can move large objects and make it appear as if I am just fine but not for long. I if I keep moving large objects or even do basic cleaning for a long time it hurts really badly. I have even had a time when I could not lift a putty knife to smooth mud on a wall. I have seen doctors and had x-rays. I have heard the phrase Costochondritis and Tietze syndrome pasted around from my doctor. One doctor suggested injecting medicine in my chest to relive the pain (temporary fix). No one has suggested how to fix my problem or if there is a cure for this problem. Now, 3-4 years later, and only working for a shot time of that period I am looking in to the issue of disability. I have asked doctors about it and they have suggested that it’s just for people how are missing limbs. But I have read some of the SSI disability requirements and feel I may fit in to a small bracket. Honestly, I don’t want to go on disability. I want cured! It tears me up inside that I am basically a house husband and my wife goes to work to pay the bills for me when she wants to stay home with our daughter. I do some basic bookkeeping for her business and that is at least some thing. I really want to just go back into the swimming pool business and do what I have done for years. I can’t really relate this injury to any specific event. It just started with pain in the morning when I wake up. Now it happens all the time and seems to move around sometimes to other locations like the right side or even with pain in my ribs (very tender). Doctors don’t seem to be interested since I have no money or insurance so an MRI or bone scans are out. I have thought about talking to a lawyer but again I have no money. Basically, I don’t know what to do. I’m bagging for help! I’m not really asking for money. I want advice. Should I try for disability? Will I need a lawyer? Is there a way to fix me? Am I just a dead beat husband that needs to wake up and just get a job? That last one is what I feel but the pain is too bad to work most of the time. I can’t even sleep some nights or keep a basic schedule. P.S. No, it’s not a heart attack! Doctors waste my time every visit for an EKG. When it’s not heart related. Maybe they should learn to read their own notes! Sorry about the rant. The last doctor I saw said I should get a shot to help with the pain but he said it was a temporary fix. Is steroids something I have to have a doctor do and is it expensive? As for the desk job issue I currently do bookkeeping for my wife’s business but I can’t stay in one spot for long that also aggravates it but I guess it’s a non-issue if I can get better which is what I really want.

My husband was off work and on temporary disability due to an injury in October last year. He went back to work in late December, but is off work again due (according to the specialist assigned to his case) to complications associated with the surgery. Our primary care physician stated on the disability claim form (which he just sent in last week) that my husband - who is in constant pain and can barely stand upright for any length of time - is perfectly capable of going back to work and only cleared him for 3 days worth of disability payments. We're currently waiting for the insurance to approve some additional tests, but the specialist stated that he is definitely going to have to perform surgery to correct the problems. Is there any way that we can go through the specialist for refiling the disability paperwork, or are we just going to be completely screwed out of any paychecks until such a time that my husband is healed and can work again? It's been a month and a half with no income...and it sucks big time. Oh, and in the meantime he's been laid off from his job. They won't even let him onto the job site in the condition that he's in currently. Happy days. >_<

I work at bank of america in california. I was injured at work last year and was on temporary disability for 2 months. I went through the whole process of filling up all the paper work and the workers comp insurance that bank of america uses paid me my 2/3 pay tax free. The adjuster told me the rest would be paid by bank of america. This part I understand. Aftter the whole ordeal I talked to the HR department about the 1/3 of my pay that I didn't receive because the offset on my pay stubs was a higher amount then I received from the workers comp, they told me they do not owe me any wages because what I receive from the workers comp insurance is the net income and they have to "gross it up" or "inflate the amount" for tax purposes to lower my reportable tax income at the end of the year. They also told me not to compare the amounts of what I received from workers comp and the offset they used on my paystub because one is the net income and the other is the gross income. This I do not get because I thought the whole amount is suppose to be tax free, and also I don't even know where that 1/3 of my pay actually goes to. Can they really just increase the offset amount like that? Are they trying to rip me off or is this how workers comp works?

okay, I am in my 40's and live with a man who I used to be romantic with, but have not been in years. we sleep in separat rooms and I have a teenager. Boy. The man pays the rent but I get foos stamps, and social security disability, and all medical insurance for me and my son. My roomate is mildly retarded and it's very hard to live with and can be an added source of anxiety for me. My sister is older, married and does not really have the room for us, because she has her husband, of course, but also two grown kids still home, plus a grandson in 3nd grade. I just can't go to a shelter with my son in school, plus it only temporary. Section8/HUD is closed in my town and surrounding places, I feel so damn trapped.

So, here's our dilemma. My husband had a vasectomy 4 weeks ago and has been off work ever since, due to complication. At the moment, we are dealing with the insurance company not wanting to cover his temporary disability leave, and lying to us over the phone. His doctor has not yet cleared him for work and he is seeing him weekly until he is cleared. Money is tight, and I mean extremely tight. We're eating pretty much the same meals each week, working around the "4lbs of ground beef for $10" deal at the local grocery store. Obviously ground beef every night is not healthy for us, or four our daughter. So anyway, the dilemma is, just today, we have been hit by two bills..$400 for house insurance and $721 for property tax, due on the 27th and 28th of this month. There is no way we can afford this, alongside regular bills, life insurance, car insurance and our kids' RESPs. I only receive $430 a month in Child Tax Benefits. To help offset these costs, I keep telling my husband that I will find a job early, go back to work part-time so we don't dig deeper into debt (surprisingly, we've only managed to get $1500 in the whole over the course of a month). He keeps saying no, that we'll be fine and I don't have to worry, but I can't help but worry. Our son (9 weeks old) is exclusively breastfed, but I have no problem with pumping and leaving milk and going to work a few nights a week in the evening when my husband is home. If you were in this or a similar predicament, where your husband was unable to work, but you were capable, would you return to work early, or try to find a job to help out despite your husband's protests? Grant Ray..I'm in Canada. We get 52 weeks maternity leave, 50 weeks paid. But I haven't worked (apart from part time in a dollar store for 6 months, and home child care) since my daughter was born in March 2007.

Cant find anything The jobs there are are: -Clerical. They dont have filing or office assistant as much as they used to before. I could do those but now there's mostly Admin assistant which requires great communication and i'm not a talker. I'm not a good speaker, soo.... -Low wage jobs .. Even those companies want people with experience and i dont have experience doint many of those jobs OR if they are low wage Labor jobs like gardening or construction... they want strong guys and i have disabilities( knees and shoulder and spine) -Im also signed up at Temporary Job agencies and they haven't had anything for months. What am i supposed to do. I'm not even getting Unemployment insurance because i'm dont qualify

I have become disabled due to the lack of appropriate medical care..I was not able to get help from charity care for my chronic health problems/disabilities that need specialized treatment...now I can't work-but will be collecting disability payments (from a temporary disability policy-not SS) of about $1500 a month.. the only way I can get back to work is to get appropriate medical care-I have been trying for 8 years with the resources available to me... how do I get medical care? Are they any government programs that will pay for medical care for a disabled person to be able to work? given the facts not working-but has worked for most of the last 20 years income of just under $1500/month from disability insurance SSDI may take a while to get approved for-and at best doesn't start for 6 months-and than it is 2 years until I am eligible for medicare my condition is not really even known by most doctors--and I can't find one willing to learn and try --I have to go to a doctor that specializes in my condition--i have a couple names--but no money to pay them I live in New Jersey.

I live in GA and I am the only source of income for my family of three (about to be four) I am eight months pregnant and I do not qualify for FMLA or any type of paid maternity leave through my work. I talked to the Department of labor today and they said that since I will be unable to work then I do not qualify for unemployment insurance. A friend suggested that I may qualify for some type of short-term or temporary disability assistance, but I haven't had any luck through online searches and I do not know what agency I would even ask about something like that. Can anyone help me? I only worried about maintaining some type of income in the weeks it takes me to recover from childbirth, I do not consider children a disability. This is my second.

I have chronic pain and have been on this medication for over a year. I was laid off a few weeks ago thanks to the greed of the UAW of which I was a temporary member anyway,I can no longer afford my medication. When I went to the pharmacy the cheapest I could find them was $700. I cannot afford this but at the same time I do not have enough mobility without them to find a new job. I do not want to go on disability but I am being forced into a situation with no alternative. I cannot believe our system is setup to force a person who wants to contribute and be a part of the workforce into taking a disability check. Where is the cheapest place to get my medication or is there a program in place to help pay for them. Thanks.

This has nothing to do with SSDI. Nj has short term disability insurance for up to 6 months. I am trying to find out if there is a provision to work part time ($100/wk) and still get benefits--from what I heard it is all or nothing... I actually do better when I am working, but just had a major setback today. I can still work a couple half days......and I am afraid if I stop providing service to one of my clients he will fall through the cracks--as it is the other socalled professionals treat him like he is an cognitively impaired--yet he does have age appropriate cognitive skills--it is a 5 year old who has been sight reading at least a year--but the others insist he only knows a few letters--he knew most letters 2 years ago--they think he only recognizes a few numbers--when he can actually count at least to 10--and recognize the numbers and put them in order... it is 11 o cock at night--I can't call now--and I am worried--not to mention--It may take days to actually get somebody on the phone that will pay attention i can't hobble down to the office--they don't let you--its done through the mail--maybe I can try a singing telegram...that might stimulate their brain cells...

I have severe depression with mixed episodes. I am an introvert so days at work pull all of my energy out of me. I left work for a full month to do an intensive outpatient program and received temporary disability. If I ask to take time off again I'm going to end up losing my job. I work with a great company but am the newest hire and sit at the front desk. I'm only 23 and only been with the company since May. I can't stand working with people and I'm so depressed. Weekly one hour sessions are not enough. I have a lot of student loans and car and insurance payments to take care of and my family cannot help financially. I feel very lost. Wat can someone in my situation do to and heal from depression

I had an illness (high spikes of blood pressure) that DID require my separation from the work. My blood pressure was spiking for the first time in my life at deathly levels, (as high as 180/90) after going to work for a new company 7 days (Note my having worked for other companies for 25 years) I need to add that the only available routes to this work were highly unsafe traffic-wise with a lack of traffic cones and heavy construction and bottle-necking without warning, not to mention daily fits of road rage, one time involving a motorist point what looked to me like a gun at another motorist. It (the gun?) was covered with a cloth. I should reiterate that my blood pressure had in the past and for all my life been normal before starting employment with this company through the same temporary agency I had worked for years successfully on other assignments as long as 2 1/2 years. Sidenote, I had also worked for permanent companies for years in the past, usually five years at a time before being layed off. I went for free blood pressure readings at a local fire-station after using a blood pressure cuff of my own and wanted to verify the results. I called a clinic three times to set up a free apt because of lack of sufficient health insurance but the nurse never called me back. I made the decision to leave this work, hoping to get my blood pressure down to a non-deadly level asap. I noticed that the blood pressure medicines I read about on the web had terrible side effects that seemed to be potentially just as deadly as the blood pressure. My intention was to get the blood pressure down asap by removing myself from the unsafe environment and get back to work on a different, more safe assignment asap. This was a temp-to-perm assignment through a local temporary agency. So my question still remains. The fact is that Blood pressure at a level of 180/90 can be deadly. I left with good cause. I could not afford a doctor or hospital and I lacked sufficient health insurance. I attempted to get treatment at a clinic with no success. This is an emergency unemployment claim in the State of Florida. I am not a deadbeat! I love to work. I also need to live and not die soon. My blood pressure has returned to normal. I did what I thought was best. Why should someone without sufficient health insurance or a way to pay a hospital be discriminated against? My main question is, "Is there a LAW that protects the rights of a claimant without health insurance or a doctor at the time that nevertheless, still left with good cause?" Thank you. My blood pressure is now normal. I do not currently have medical problems. I am not disabled, therefore would not qualify for disability. I am able and available for work. The Unemployment law refers to this, so IMHO, my illness should be a factor. It is my understanding from the web that employers do not pay emergency unemployment benefits, perhaps the State does? I did check with my supervisor. I wrote her an e-mail and called her. She was out of the office and did not reply to my e-mail. I have the e-mail. The e-mail was not returned so she received it. It is unknown to me whether she read it. I welcome responses from those with "sources"and/or especially unemployment judges, legal staff with an applicable law that supports my lack of a doctor's note because of insufficient insurance or ability to pay.

Considering the following socialist programs, isn’t it odd to now be yelling "Socialist" at someone for merely wanting affordable healthcare? Don't you think calling Obama a socialist is a tad extreme when you consider the facts? I totaly agree Subwm. Comee, that is achieving the same goal as the other programs in a more sensible way. I am in the higher tax bracket and I can tell you from personal history that for every dime he raises my taxes I can write off more then enough to cover it. It won't effect me that much trust me, I don't mind cutting back on a couple grande lattes to help America have a stronger economy. Obama is not a socialist any more then the ones that passed these programs. The elite have gotten more then a fair shake and my tax bracket has had plenty of breaks in my taxes I think turn about is fair play. BTW Obama didn't write the bail out and I'll point out that it is McCain’s economic plan that is actually yet another bail out by purchasing bad mortgages from the bans... I am grateful for my economic standing and what I have been able to achieve. I have been lucky and blessed. As I said, you are way off base. @Chanc... I read again what you've said and I must say in the U.S. you couldn't get health care coverage for 5k a year. Before my biz. took off I paid over 5k a year through my employers as part of a package, It costs me 12k a year now
