Open Question: Do I have a right to sue my former employer?
(Fri, 12 Mar 2010 03:17:21 GMT)
I began working for a company in oct.2008. I was a service tech. i had a company vehicle that i drove home everyday. When i would use parts of my van, they were replenished via ups to my home from the company. well in jun of 09 i was taken out of work by my doctor due to a back injury ( not work related). i had to turn in my van when this happened. well for the first month or so out of work i was still receiving parts at my house. so i put the parts in a closet for safe keeping. I was finally able to return to work in oct of 09. well I did not need the parts on my truck at that time. In the beginning of feb i had a relapse with my back and had to stop working again. this time i was denied short term disability, and was falling behind in rent. so i moved in with family. Since i was unable to move anything, i had some family help me. my stuff was moved to a storage shed. i then found out that those parts were left. well my landlord would not let me back in to get the parts. i ten found out they were picked up by the company. I was fired just today. while on medical leave. the reason i was given was because i did not follow company policy pertaining to the parts. now i am going to loose my insurance, and more than likely be denied unemployment because i am unable to work per my doctor. so my question is, do i have any rights. or do i have a lawsuit that i can file against the company. I mean how can they fire someone that is on medical leave. And i am thinking I'm completely screwed. Can anyone help or give advice on this. thank you so much

Resolved Question: Can my employer pay on top of what I get for short-term disability?
(Mon, 08 Mar 2010 17:52:25 GMT)
Last week I had an emergency appendectomy and missed 4 days of work. I am covered by short-term disability, but do not want to take a pay cut. The short-term disability would pay 60% of my pay, but is capped at an amount below 50% of my weekly pay. My goal is to not take a pay cut, and the one sure way of doing this is to use 4 of my vacation days (I only get 10) for the missed days. However, if I file for short-term disability, can my company make up the difference in pay by using 1-2 of my vacation days? The HR manager is waiting a call back from our insurance agent regarding this, but I thought I might get a quicker answer here. The surgeon wrote me an excuse note through Wednesday, but said I could return earlier. I am currently back at work, I am not feeling so hot, but don't want to go home if it means using a partial vacation day. There's a way to claim the short-term disability if I come back part time, which I was planning on doing, but I want to make sure that me working a full day today won't jeopordize me from claiming short-term disability for Tues-Fri of last week.

Resolved Question: I'm trying to get pregnant. Can I get short-term disability insurance now?
(Sun, 28 Feb 2010 21:43:28 GMT)
So I just talked to a friend of mine who is 11 weeks pregnant and she was telling me about all the disability leave options and I wondered if disability insurance like Aflac will cover the difference in wages. On their website it says it does but only if you give birth more than 10 months after the policy is effective. I'm not pregnant yet but should ovulate any day. This is our second round on Clomid. I ovulated last time but we did not get pregnant. I'm really hoping this is our month. Is there any point to getting the coverage now? Would I have a chance of getting coverage for a normal pregnancy with it if I did get pregnant this time? I know that if I don't get pregnant this time, I should have the coverage so that I'll be in the clear if I get pregnant next time. I also know it can cover for disability due to pregnancy-related illness from a non-normal pregnancy so it may have value there also. I am going to get it regardless, I'm just wondering if I get it next week, and ovulate next week if I will give birth after their time restriction. Any thoughts advice or opinions?

(Sun, 28 Feb 2010 19:22:58 GMT)
have worked 11 1/2 months over 1500 hours in Florida I want to protect my job and concerned if i take the leave i may not have a job to come back to. Also do I loose my health insurance if i can't pay it while off work and what happens with my 401K If i am not getting paid can i qualify for unemployment or anything? Would it not make more sense to take a short term disability?

Resolved Question: Does anyone have a clue of what we will be getting back from our lawsuit?
(Wed, 24 Feb 2010 20:23:34 GMT)
My husband was driving to work 2 months ago and he was hit by a girl who was driving too fast and lost control and ended up in his lane. She was issued a ticket for driving too fast in current conditions. My husband has not been the same since the accident. He just had an MRI and they found that he has two ruptured herniated discs in his back, and two more that are mildly bulging. Because the discs are low in his back and pushing on nerves he has been unable to walk or even sit or stand or lay comfortably since the accident. He has missed 2 weeks of work directly following the accident, and he is now out again and is going to face back surgery in a month. We did hire a lawyer 2 weeks after the accident because the girl at fault was not answering the calls from her insurance company. (She has since admitted being fully at fault and we have a police report to prove it) Does anyone have any idea at all the $ value that we will get back in this case? We are wondering because the next 90 days he will not be getting paid at work for since he was unaware that his short term disability was removed off his benefits plan 5 years ago. Ahh so frustrating.. :( I guess what I am asking is has anyone been in a similar situation? Was the outcome good? Joe, I think you are prob. correct. Only thing is that it was her Mom's insurance. She wasn't even listed as an authorized driver, but the car was insured so we got lucky there.. She is an 18 year old with a PT job.... We don't want to make money, just want to be compensated for all missed time from work and medical bills etc :( I have a feeling we aren't even going to get enough to cover that.. I didn't know about the whole bankruptcy thing.. Good to know! I just don't know if her mom would be sued since it was her insurance, or the driver..

Resolved Question: Approved for STD, Don't want to go back to work, payback benefits?
(Mon, 15 Feb 2010 23:59:59 GMT)
I have a physical job and became pregnant and thus disabled. I was approved for Short Term Disability and it will end in April. After April I will need to apply for LTD and pay for COBRA. Here are my two issues. 1.I currently still have health insurance through my work. I also had a secondary health insurance through my husbands work. He was laidoff last week. He now qualifies for a discounted Cobra premium. Because I have health insurance through my job, I would not qualify for the discounted Cobra under my husbands health insurance. I would like to quit my job, so that my health insurance will end and I can qualify under my husbands discounted Cobra. If my math is correct, it will cost us $1000 less if I completely quit, stop STD, and stop my health insurance and go with my husbands health insurance with the discounted Cobra. I'll have to make a call to the Dept of Labor to see if this is even possible. 2. If I quit my job now, without going back to work, will I have to payback any of the STD benefits that I have recieved so far? As things are right now, I'm pretty sure I could continue to qualify and get approved for disability insurance until I have my baby in July, if that makes any difference. I was under my husband's insurance at the time he was laid off. I also have my own health insurance through my employer. My husband qualifies for the Cobra discount because he was laid off before February 28, 2010 which is the last day that someone can qualify. Also, my employer decided that I was disabled. I did not refuse work. I had a dr.'s note stating that I couldn't repetivitely lift over 20lbs. Even though includes only about 10% of my job description, my boss told me that "my remaining shifts had been cancelled and that they were unable to work me due to my restrictions" and they recommended that I file for STD. They didn't want to accomodate me at all on this small request.

Resolved Question: Are there short term disability plans that will cover my salary 100% during my maternity leave?
(Mon, 15 Feb 2010 19:52:32 GMT)
My company does not offer any sort of paid maternity leave, so I was planning on buying short term disability insurance to cover part of my 12 week maternity leave. Are there short term disability plans that will cover my salary 100%. Does anyone have one they have used and that they can recommend? Thanks!

Resolved Question: My daughter in law works for a company that is being sold out to another company. She is 8 months pre?
(Fri, 12 Feb 2010 23:28:54 GMT)
My daughter in law works for a company that is being sold out to another company. She is 8 months pregnant and just found out this is to take place next week. She has been paying extra for several years for a short term disability coverage that would cover maternity leave. The company is planning on laying all the employees off, then the new company is going to offer to rehire with a pay cut. The new company is keeping the same insurance, but will this effect her maternity pay? Should she go ahead and go on her maternity leave early to claim her benefits?

Will the insurance still be in effect? This is my daughter in law, she is 8 months pregnant and has worked for this company for 10 years. What will be her best choice to do, she is thinking about getting the doctor to put her out of work now and start drawing her disability, What should she do?

Voting Question: I have Rheumatoid Arthritis that causes me problems that prevent me from performing my duties as a nurse.?
(Mon, 08 Feb 2010 18:47:52 GMT)
I have had FMLA and used it but now have been put on disability by my Dr. for two months and have been told by my employer that I am out of FMLA. I do have short term disability and long term disability through my employer and have filed a STD claim. My question is three fold - Can they fire me for not being there without FMLA even though I have a documented disability? Should I wait for them to fire me or resign in order to receive unemployment benefits? Will I lose my disability insurance if I quit or am fired? I'm not understanding why I have long term disability then because what if you do have a long term disability that runs past the 12 weeks per year of FMLA and you have already filed a claim? Are they bound to pay that claim or can they cut you off because you no longer work there. I've already checked into COBRA and have been told that only the health insurance is eligible for that and not the disability insurance. Real scared here and need advice.

Resolved Question: Veterans Association + Short Term Disability Insurance?
(Sat, 06 Feb 2010 21:01:44 GMT)
My Dad has ALS and was granted Short Term Disability (has to run out before he is eligible for Long Term) and is receiving 60% for of his income. He is also a Vietnam Veteran and was granted 100% benefits from the VA and has been receiving payments from the VA. We were just informed that he may not be eligible to receive both the STD payments and his Veteran's Benefits. Is this correct? The VA told us that he should be able to get both, but the STD provider is telling us that he cannot receive both and that he will have to pay back the difference of of the STD minus the VA benefits (which is rediculous because the VA benefits are double the STD payments). How do I find out what is correct when we are getting conflicting answers?

Voting Question: I have made a lot of mistakes Do I amend my taxes?
(Tue, 02 Feb 2010 14:26:26 GMT)
I made a lot of mistakes on my 2009 taxes this year. I cheated myself also. I just received a 1099 from SS and also just receive another w2 from my insurance company when I was out on short term disability. I truly need to amend my taxes. I also forgot that I took a $1000.out of my 401k to help for the death of a relative. When I went back and corrected all of this my refund changed from $ 6219 to $7301. My refund date was 2/5 then it changed to 2/9 and when I checked this morning it has changed to 2/16. with all of my mistakes could this be why my taxes are in the error dept. I truly need some help

Resolved Question: Can you collect some sort of disability while pregnant and very sick?
(Mon, 01 Feb 2010 21:55:50 GMT)
I'm not pregnant but I am curious. If someone was pregnant and if their doctor places the pregnant woman on bed rest early in the pregnancy (3 months or so) is there some type of disability that can be collected? I'm not talking about through private insurance (short term disability) but anything from the state, etc.? And also, if the husband is working but it isn't enough, how would one survive paying bills? I just wonder cause this has to be a common occurence. Thanks My question doesn't pertain to someone who gets pregnant and who can't afford it. And i'm not asking for any social commentary. Everyone knows most people are just one paycheck away from being homeless. I'm asking what will happen if someone plans for a pregnancy and is prepared, but then gets a COMPLICATION (not forseen) and cannot work. I'm just curious.

Resolved Question: Should I look for another job?
(Sun, 31 Jan 2010 05:14:10 GMT)
I would like to get the advice of others with my dilemma. I am currently very unhappy at my present job which I have only been at for 7 months. It isn't the work I do, but the conditions. My husband, 3 kids, and I moved 14 hours in order for me to take this position (in which I was desperately needed). The owner of the business has not upheld her side of the contract. After 90 days of employment, I was supposed to receive health insurance, dental and vision insurance, 401 K, short term disability, paid continuing education, and life insurance. I have seen none of these things. I have asked repeatedly about them, and she has always told me she is "working" on it. On top of this, she has me so booked that I work over 8 hours without any break what so ever (unless one of my clients cancel). I feel I am being used and it is very frustrating. I don't want to be a job hopper, however. On the other hand, I feel I have not been treated fairly. I do get paid a great salary, but she is making a bundle off of me too (over 40,000 a month because I calculated LOL). On the other hand, I love working the kids I work with (or most anyway) and I hate to leave them. Any advice?

Voting Question: Anyone know some Federal tax questions? Related to combined disability, unemployment, and regular income...?
(Wed, 27 Jan 2010 20:53:45 GMT)
A friend worked only 11 weeks during early 2009 earning just over ten grand. She then had a serious knee operation and went onto puny company funded 710 dollars a month short term disability for 6 months. finally, she got some unemployment payments for a few months. This was in NY State. Of course, she had a lot of out of pocket med costs for MD visits, tests, physical therapy, travel, phone, other medical payments which total up, plus some other deductibles if she files the long form with miscellaneous deductions... in NY. How does all this figure on both Federal tax returns as well as NY State tax dept. returns? Does the unemployment insurance count as regular income dollar for dollar....what about the short term disability payments? Any Special things and forms to do/use?

(Tue, 19 Jan 2010 18:20:05 GMT)
Ok so I made $26k before I was injured in a atv wreck in august and the received 4800 over the course of the last 5 months for short term disability that they did not tax. So I need to know what is tax deductible as far as medical expenses are concerened? As of so far I have paid around 4500 in total medical expenses and my insurance has payed nearly 45k for my humerus surgery. I'm still currently off work with all of my normal expenses rent...etc. How can I make sure I get the maximum refund?

Resolved Question: Should I file a complaint to my states Insurance Commissioner about my short term disability insurance company?
(Mon, 18 Jan 2010 01:40:37 GMT)
I paid for short term disability through my employer when I was employed. Then I got an illness and had to have several surgeries in succession and I lost my job. I filed a claim which they received 1 month and 2 weeks ago. After 1 month they asked for 2 more forms to be filled out; 1 by my ex-employer and 1 more by my doctor (Which I think was a duplicate). That was one week ago. I contacted the sales lady, and she said she is working on it, and I should receive an answer on this coming Tuesday (day after MLK Day). Should I file a complaint before that date comes with the state or wait to see if they attempt to delay my payment more? The coverage was in place at the time the claim was filed and a payment was made for the month before I was let go.

Resolved Question: What company will offer short term disability insurance on and individual basis?
(Sat, 16 Jan 2010 04:22:19 GMT)
I am in a weekend-only program at my job. My employer does offer STDI, but not to employees in this program. I can't even take a payroll deduction and pay for it myself. I am having a tough time finding an insurance company that will offer STD to me as an individual. Have you used a reputable company that you could recommend? Aflac replied that they only do payroll deduction at this time....

Resolved Question: Short term disability pay after pregnancy?
(Tue, 12 Jan 2010 20:34:57 GMT)
I have medcost insurance and am entitled to 12 weeks of unpaid leave from my company when the baby comes. My short term disability pays 60% of my salary, but this I'm told is only for as long as my doctor okays me for. I'm told the standard is 6 weeks. I need to take the full 12 as it's our first child and I have no family here to help me with him. Of course I'd love to have the full 12 at 60% rather than only 6. Does anybody have any experience with this?

Resolved Question: Went to E.R. three time in one day with stroke symptoms. Sent home each time being told it was sinusitis.?
(Sun, 10 Jan 2010 10:01:50 GMT)
My husband is 39 years old and was exhibiting symptoms of a stroke, dizziness, blurred vision, weakness on right side of body, uncontrollable twitching, slurred speech, incoherent at times, etc. We went to the E.R. four times over Saturday and Sunday and each time he was sent home after being told he was fine and had nothing more than a sinus infection. At the final visit my husband was begging the doctor to admit him because he knew something was wrong and it was not sinusitis. The E.R. doc refused saying there was no way he was going to admit him for a simple sinus infection. Told him to quit being a hypochondriac and to go home and rest because he was just fine. After failing to improve, that Monday he was seen by his regular doctor who immediately sent him for an MRI and an MRA. It turns out that over that weekend , probably on Sunday, according to the Nuerologist, he had a stroke. Now, we are stuck with four bills for the E.R. that our insurance is refusing to pay because the official diagnosis the original E.R. doc gave is sinusitis not a stroke. We have hospital bills and specialist bills that are going to have to be paid. Yes we have insurance, but there are still deductibles and co-pays that will have to be paid for months if not years. Is there anything that we can do in terms of the E.R. doc and the hospital? I fail to see why we should pay for a mistake that ultimately could have killed my husband. He is currently on short term disability at 50% pay, as yet we don't know when or if he will improve enough to return to work. Our lives have forever been altered by a doctor and hospital that refused to take the time and do a thorough examination and instead just wanted us out of there as quickly as possible. I could have lost my husband, my children could have lost their dad and my husband could have lost his life. Is there anything that we can do? Thank you and if you need any further clarification, just ask.

Resolved Question: Can anyone give me some free legal advice?
(Sat, 09 Jan 2010 22:55:03 GMT)
Divorced 5 yrs ago and by my own mistake I never thought to take my ex off my insurance, my boss is now holding this against me from either stating I am no longer and employee so that I can file for my umemployment. I am out on sick leave with doctors excuses and my boss is also refusing to sign my short term disability form he has also showed my dr.'s excuses to all the other employees stating that they are fake (which they are not) and the insurance company is sending out a packet giving us the chance to remove any dependents we should'nt have on our policy. My question is, is this legal what my boss is doing and do I have any rights in this matter? There was no attempt to defraud we never seperated and thought we were common law married.

Resolved Question: Are there any financial assistance programs available to those who are ill/out of work for a time, that can?
(Sat, 09 Jan 2010 17:59:18 GMT)
help the patient with their living expenses? I have heard that Salvation Army or Red Cross may help with utilities while one is not able to work, but not sure about mortgage payments? I was diagnosed with a brain tumor (non-cancerous) 4 years ago, and doc told me yesterday that it is time to remove the tumor as it keeps getting bigger and causing my brain to swell, and told me that he has my surgery scheduled for 2/24/10....that is coming up quick! I have health insurance and short term disability with my job, however at my job when out on short term disability you only get paid 60% of your regular salary, I know because I was out 2 weeks in August for female surgery. The problem is, I am on the cusp of bankruptcy, I owe another $140 to my attorney and then he will file my case.....I have been chipping away at this $1875 since this past summer. I drive an 11 year old car and I live in a mobile home, so there definately no extravgances here. I am paying my mortgage about 30 days behind and at one point at the end of the year got I 2 months behind and had to come up with $2300 in 1 month time to cure the default. Needless to say, there was no Christmas, but there also was not much left even for food.....I was able to get a food handout from a local church but it wasn't much. My thinking is that if I am already struggling while working full time, how will I ever be able to make it when I am off work for 1 whole month at only 60% of my wages? I hate being in this position, but medical bills and being left by my fiancee early last year, put me in a financial downward spiral.....I have had to pay everything on my own and I would venture to say I probably have a credit score of -100. I have even started renting out rooms in my house, yet it still isn't enough. Is there ANYWHRE, where I could get help with my mortgage, electric and maybe some food? I do have bank statements/paystubs and etc to backup my case, but where would I go to get help without having to go through a lot of red tape, as I don't have a lot of time? I am not on any public assistance programs and never have been as I have always made too much $, so I really do not know where to even begin? If anyone out here has been through a sugery/illness for an extended period of time or if you know someone who has and they were able to get some kind of help, so they didn't end up without electricity, hungry or homeless, I would be very interested in hearing about your experience and how you were able to get help. One last thing, I do have a minor child in the home and yes, I do get child support for him, but it's really not that much. I live in Tampa, Florida (Hillsborough County) Please advise and thank you for reading.

Resolved Question: Need Help and Advice on how to help someone with cancer and family deal with what will happen.?
(Thu, 07 Jan 2010 20:59:00 GMT)
I have exhausted my options. I don't know where to turn to for help. My Boyfriends mother was diagnosed with Brain cancer in June of 2009. She was given 1-2 years. She went on short term disability an that has ended. She is not eligible for long term. My boyfriend and I moved up here to take care of her and her boyfriend whom is recovering from a stroke. His mom is no longer going to have money coming in and finding a job here is nothing short of a miracle. I don't know what to do. How can we get money coming in so she can keep her insurance so she can continue to get her medications and go to her appointments? How can I help my boyfriend deal with all this and help him deal with the fact that his mom has a terminal illness. I know everyone says being there is what means so much but reality it's not enough. Just being here saying it will work out and that it will be ok is not reality. What can I do to get some money coming in and help them deal with the inevitable. Me and him are also starting college in just a few days. Only part time but we have to be here every 4 hours for medications and to make all meals. Figure out how to keep all the bills payed and food coming in, plus get ready to try and start our school. We had to quit our jobs to be here and now we just don't know what to do. How to help. How to deal. We need help. .We need advice and I need to know how to help him deal with it all and to stay strong for him. I was considering talking with hospice. What I am wondering is are they free? We have no way of paying them for any services what so ever. We also don't know exactly how long she has to lived. She was diagnosed June of last year and they said 1-2 years max with treatments. Would be less without treatment and if we can't pay then she can't get treatment. Are they really helpful? Anyone who has went to them in a similar situation that could give me some advice?

Resolved Question: Do I have a valid lawsuit?

I was recently fired from my employer about a week ago and the following circumstances happened. I was pregnant last year and I was one month short of receiving maternity leave so therefore they gave me short term disability. Upon returning to work I received a write up being notified that I was on my final notice. I never have received a warning or any write up as it states they would provide in their employee handbook/policies. You are supposed to receive a warning write up, 2nd write up, and then a final writeup. They just instantly put me on my final. My one year old daughter just recently started having some medical issues in which I had to take her to emergency room a couple of times as well as the doctor numerous times. I was late 2-3 times coming back from doctor appointments and they pulled me off to the side the other day and notified me that I was fired. I even had doctors notes and they would not take them or even look at them. I feel that after working for this company for over 2 years I was cheated out of my job. I have never been fired from any job in my life and I'm 31 years old. I also believe that I was discriminated against for being pregnant is how this feels. This company didn't even follow their own policy guidelines and now a week before christmas I'm left without a job and my families insurance is now over at the end of the month. My daughter now has to have her surgeries tomorrow morning in order for my insurance to cover the expenses. Please let me know your opinions. Thanks :) I also need to mention that I never even new about FMLA and I was told this is their duty to inform employees of this option. I also had 10 days of vacation left which they could have taken time out of that.

Resolved Question: High blood pressure 23 weeks?
(Wed, 16 Dec 2009 17:27:17 GMT)
I have been off work for high blood pressure since I was 9 weeks pregnant. While I was working my blood pressure was through the roof (stressful job). I am now finishing up my short term disability which i had taken through EI since my work doesn't cover it until you've been there two years. I am eligible for Long term disability which i have already applied for and I am now just waiting for approval. I was talking with my benefits department through work and he informed me there is a VERY slim chance I will actually be approved since he figures high blood pressure is not a danger to my unborn childs life, or my life for that matter. I am not currently on medication because my doctor won't put me on it until I am at least 26-28 weeks to prevent premature labor...and she feels it is a last resort since right now in my second trimester it has come down past the danger point (which is normal since it often lowers in your second trimester) and the fact that i am NOT working is helping keep it down. I thought high blood pressure was in fact something to take seriously in pregnancy? It seems like no matter what my doctor puts on the forms it doesn't matter to the insurance company! Can someone tell me what all of the risks are with high blood pressure to myself as well as my baby? and if anyone has had a similar type experience please share..I am so frustrated!

Resolved Question: Pregnancy and Long Term Disability?
(Tue, 15 Dec 2009 21:59:48 GMT)
I don't know if many of you will be able to help me out but I'm getting kind of nervous... My doctor took me off work at 9 weeks due to high blood pressure and I have been on short term disability through EI since then. I am now 23 weeks and I have applied for long term disability through my insurance company through work. I was reading everything over and it seems like only really serious conditions get approved and if it isn't as "serious" it can take 10+ weeks sometimes. I know every insurance company is probably different but I imagine they have some basic guidelines to go by...Are you likely to get approved when the problem is due to pregnancy? I will only be on it until I deliver then i will on maternity leave through EI. I just really hope they take it as "serious" My doctor did a half assed job filling out the forms so that concerns me a bit to. Has anyone ever been on ltd while pregnant or have you ever been declined?? Mr. Awesome...I know you're just an idiot plain and simple, but I pay into EI out of every single one of my pay cheques I have received my entire life. I am off work due to medical reasons I am not off simply because I don't want to work. I think these 15 weeks i'm receiving from EI I have earned. For those of you seriously answering my question (thank you) they define "Serious" as cancer, heart conditions, broken bones..ect. It isn't exactly life threatening to me, but it does increase my chances of pre mature labor therefor threatening my babies life. I guess I just need to wait and see!!

Resolved Question: Long Term Disability - Help!?
(Sat, 12 Dec 2009 13:01:39 GMT)
I have been on STD (short-term disability) through my employer for almost 4 months. I returned to work on November 9, 2009 on modified hours and will continue to be working them indefinitely at this point. I have been advised that my STD weeks are almost over so I now have to apply for LTD (long term disability). I received a letter from my Human Resources indicating that I will no longer be on their payroll and my "deductions will be in arrears, until my return". I am actually quite confused by that since it is not like I am not working at all, I have returned to work just on modified hours. My HR person and the insurance company are unavailable to answer any of my questions and I am feeling completely stressed. Can anyone explain to me in general how LTD works because the way it seems it is like I am going to end up my company money, lose my benefits, and my vacation. Any feed back is appreciated! @ memaw: Being on disability because I am only working modified hours, so it would supplement my income since I am not working full time hours, I hope that makes sense, from my understanding. @ rayt721: I appreciate your honesty and just reinforce what I already know.

Resolved Question: how to obtain long term disability settlement?
(Thu, 10 Dec 2009 18:34:02 GMT)
Hi, A family member has been off work for over 5 years receiving long term disability benefits. He/She is in a financial bind and could really use a lump sum settlement. Short of hiring a lawyer is there a way to encourage an insurance company to offer a settlement?? If so how should one go about it? Thanks In Advance

Voting Question: Short Term Disability and Changing Jobs?
(Wed, 09 Dec 2009 17:11:02 GMT)
I am pregnant and due in 6 months. I may be changing jobs in another month. In my current job, I have been signed up for short-term disability for the past two years. When I move to my new job, will I be subject to the ten month waiting period for short-term disability benefits for maternity leave, or will I be covered since I had the insurance at my previous job for more than ten months?

Resolved Question: does anyone else think this is insane? health insurance policies?
(Mon, 07 Dec 2009 14:29:58 GMT)
If I got addicted to drugs or alcohol, I could get a month stay at a rehab center - totally paid and other special dispensations....short term disability, and a leave of absence. If I got pregnant from a rape --- my abortion wouldn't be covered. If I was the victim of a violent crime (which I was) insurance only marginally attempts to cover any counseling or psychiatry. So how is it that I can get addicted to drugs or alcohol as a coping mechanism --- and end up on the better end of the deal?!!!! Instead I try to do the right thing and I can't afford it. I mean no offense -- but depression and anxiety are legit diseases too. How come they don't merrit the same rehab or help? This is unbelievable.

Resolved Question: Getting Sick while on Active Orders?
(Sun, 06 Dec 2009 03:25:49 GMT)
I'm in the National Guard, been on Active Duty for the past 5 months for some training. I got Mono and Anemia while here and had to drop out of training. Since I'm Guard they are going to send me home for 3 - 4 months until I get better, then I come back and go through it again. If I was on Active Duty, I'd be taken care of. Being that I'm Guard, when I get off orders, I won't get Medical Benefits, I'll have to use my civilian insurance and pay out of pocket. Also I'll have to go back to my civilian job. If I had gotten sick while working as a civilian, I would have been out on Short Term disability (mono takes months to recover from). Does anyone know of any options to where I'd still be taken care of by the Guard, maybe kept on orders for a month or two until I heal?

Voting Question: How do you report an employer for taking too much out of your check. I agreed to a certain amount.?
(Fri, 04 Dec 2009 10:50:15 GMT)
When I was on mat leave from July to Nov, they paid me my Short Term Disability. They stated that my insurance would come out of that and I would get a check for the difference. Well I started back in November my first check back they had taken 200 something out plus the 200 for my insurance plus my taxes. I went to accounting and they stated I owed them the insurance payment the 3 months I was off. I asked them about the STD payment that they gave me and they stated that it didn't pay anything. So we aggreed to 100 a week so 200 every pay period till it was paid off. I got my check last night and they took over 600 for my past due insurance plus my insurance payment and taxes, which left me a whopping 59 dollars. I can't support 3 kids on 59 bucks, and my employer is doing crap she won't answer the phone or talk to me. Is there anyone I can report them too. Thanks in advance I guess I wasnt clean in the fact that i have it in writing from accounting that they were supposed to take 100 a week after the whole mix up. And where I leave in Ohio the food pantrys are empty from gm's ex workers, and my family is in Cali. I don't need smart a** answers, I need answers on where i can report this or how to rectify the situation.

Resolved Question: How to avoid IRS fine for underpaid withholding?
(Thu, 03 Dec 2009 15:15:36 GMT)
My wife was on short term disability for about 5 months this year with a tough pregnancy. The insurance company did not withhold taxes from the checks. The week she went back to work, she got laid off, so she has been on unemployment since then and also had no withholding coming from the checks. I have the money to pay the taxes we'll owe on her income, but I am told there is a fine for not withholding enough through the year. Will I truly be fined under the circumstances described? If so, can I make an estimated tax payment now (before end of year)to avoid this fine? Any other way to avoid it?

Resolved Question: Short term disability question.....?
(Wed, 02 Dec 2009 02:38:57 GMT)
I was just dx with anxiety/depression/personality disorder yesterday and the therapist requested that i do intensive outpatient thereapy 5/days a week for 3 weeks and I have started the FMLA and STD paperwork for my job? Its hard times and the holidays and I am worried about money. Do people generally get approved for this diagnosis? I work for an insurance company (WellPoint) so i know they are a bit more understanding of stress/depression on the job, but I am really freaking out right now because i was dx on my first visit to the dr with no prior treatment for 8 years.

(Wed, 18 Nov 2009 13:43:58 GMT)
I have two bulging disks- disability closed my claim. My work will not let me return until the lift restriction is done. Can the insurance company do this?

Resolved Question: HELP!!!Any insurance co/other resources will offer Short term disability wilth prior injury?
(Sun, 01 Nov 2009 00:10:48 GMT)
I live in Michigan/ 26/single/no dependants/live alone/unemployed b.c of a injury I obtained. I am on LOA off of work. I have surgery 11/4 and my insurance will only cover the MRI. The surgery for my ACL reconstruction/physical therapy/athe/hospital/post doc visits are not covered in my insurance. I dont have short term disability ( yes my job offers it but I cant get it because its a prior injury and I cannot add to my premium since I am not working and they deduct it from payroll. And the only state aid I can get is food stamps. I have a job waiting for me to come back but I am worrired about how to pay for my medical bills and get some time of money to help bills in the mean time since I will be off of work for 4 month at least. Does any one know of any programs I can apply for in the state of Michigan (other than the county plan b or the adult medical program) Is there any insurance companies or other resources that I can get short term disability with a prior injury. I am willing to pay for the premium out of pocket. Any others suggestion plz help!! Thanks :) LV

Resolved Question: Do you know anything about AFLAC short-term disability insurance.?
(Thu, 29 Oct 2009 00:21:37 GMT)
Anything you can tell me would be helpful......... Various sales people who work for AFLAC continue to call me through the years and want to show me this great service for employees. I'm irritated by their persistence, but at the same time, I am curious to know what they are so excited to show me.

Resolved Question: short term disability for mental health, not covered by my employer?
(Thu, 22 Oct 2009 14:58:16 GMT)
This summer I switched from full time status to part time status due to family issues, and I have been working for my employer for over two years. I am a very dedicated employee, always working extra hours when I can. However, our short term disability policy is that you have to work 30 or more hours per week. I generally work between 20 and 30, so that would not qualify me. I'm trying to get on state insurance right now, and I've started seeing a therapist, who is sending me to a psychiatrist in 4 weeks, to try and determine what is wrong with me. I think I am bipolor, they think I am depressed or that I have post traumatic stress disorder with problems stemming from my childhood. I don't knwo what the hell is wrong with me, but it's just getting worse and worse and worse everyday, and they won't give me meds until I actually see the psychiatrist. I cannot function at work. I cannot concentrate, focus, i snap at my coworkers, i have to go to the bathroom and let myself cry for 10 minutes and come back in and continue to work. I am not doing as great a job as I used to, obviously. So, my question is, is there anyway I can get some sort of temporary paid time off to cope with this illness that I have? I really feel I'm just going to end up getting myself fired, and how is that really my fault? I cannot control what my brain is doing. it's really really frustrating!!! I live in Connecticut. If anyone has any info for me, please help! thanks. I'm not looking for a handout. I'm not looking to stop working. I'm looking for a little help while I get things into check. It is all coming at me so fast I just need like 2 weeks off to take a break and to focus on therapy and talking and coping. I want to prevent myself from screwing up my job because let's face it, anyone can get my job. unemployment is sky high right now. I'm the last person who would suck off of the goverment tit because I'm too lazy to do anything else. Those programs aren't there to be abused, but there is a reason for them. TEMPORARY help is all I'm looking for. I want to figure things out. I've never dealt with any of this before and I don't want to be misdiagnosed. I want to be able to devote all my time right now to focusing on my mental health. That's the only reason I asked.

Voting Question: Maternity leave, NY state short term disability maternity leave-when does it start?
(Sun, 18 Oct 2009 22:37:57 GMT)
I have gotten a few different answers on this and its just confusing me. I am going to be receiving NY state short term disability insurance for my maternity leave. Does that start from the day I actually go into the hospital to have the baby then 6 weeks after? if I go out before the day I go into labor then do I not get paid unless I have a doctors note? Then 2nd part to that question if someone knows the answer, if I do have a doctors note to go out early would my 6 weeks start then or would I get paid for whatever time I went out early with doctors note plus the 6 weeks? I have looked online for this answer but of course NY state websites are not too helpful at all. I am going to meet with my HR rep at work next week but its been making me anxious lately not knowing about this and I only have 3 weeks to go. Worried about going early and not knowing how this works. PLEASE only answer if you are sure, no guessing

Resolved Question: boss and work issues?
(Sat, 10 Oct 2009 17:21:37 GMT)
First of all I am grateful I have a job, this is not a comlaint. But anyways about 6 months ago I was diagnosed with cancer. hen all of the sudden about 3 months ago i started seeing a change in my pay. They said it had something to do with insurance so I sucked it up and decided to wait till open enrollment. I was approved for short term disability and then when i came back they said i wa not out for more than 21 days so i was not going to get paid. That really messed me up. I work for a contract company through the hospital i work at. i don't have a prob w/ the hosp, just the company. My supervisor at the hosp is bending over backwards to help me out right now, even lying for me. But yesterday I got so pissed I said I may be putting in my notice to quit cause i can't handle the stress. Then i asked him what they want me to do, Do they want me to quit, take leave or stay. My super got mad and yelled at me and i left for my treatment. Do you think he will forgive me if I apologize to him? I really was not trying to be ungratefull, just so stressed out

Resolved Question: What would you do in my situation....14 weeks....drama?
(Wed, 07 Oct 2009 19:39:33 GMT)
So here is my situation. I am 14 weeks pregnant. I have not told my employer yet. I have been to the doc 1 time for my 1st visit. I am going back Nov 3rd. Reason being I quit my old job to take a teaching pos. I was advised that I wait til Nov 3rd to go to doc otherwise my insurance will not cover it and I wont get short term disability. So I am waiting until Nov 3rd to tell my school. Today I had a parent volunteer in and she came up to me and poked my stomach and said "Are you pregnant" I panicked and said no...at least I don't think so. Because I don't want her to blab it around the community and the principal and school find out that way....what would you do if you were in my situation? Just blow it off and wait til Nov 3rd then tell everyone and say to her I guess you were right??? My fiance says the only one I have to tell is my principal and other ppl dont have to know until I announce my maternity leave??? Ugggh all the drama..lol...sorry such a long question!
