I had an industrial disability settlement while I was married. Can my wife ask for 1/2 of it even though we've been separated for 12 years and it was in our possession while we were together? |

Resolved Question: What are your options when you go out on maternity leave?
(Mon, 18 May 2009 18:29:27 GMT)
How long and how much do you get from NJ disability? Do you get SSI and for how long? I pay into a short term disability for how long will I get it? What are my FMLA rights? I know that Governor Corzine recently signed legislation that will provide New Jersey employees with up to six weeks of paid family leave under the state’s temporary disability insurance program. The law goes into effect July 1, 2009. This benefit will be 100% paid by the employee, but when will I get it?

Resolved Question: NJ Tax withheld for PA Resident?
(Wed, 18 Mar 2009 20:12:06 GMT)
Hi,
I am on L2 and I started working from Sep 29 2008. I live in PA and I my office is in NJ. PA WITHHOLDNG of $ 468.37 (total for 3 months)is deducted from my salary
Also NJ Tax for the following items are been deducted each paycheck. A total of $141.34 is deducted from my salary in 2008 -
NJ UNEMPL EE - 58.45
NJ NJ WDPF - 3.82
NJ NJ SWAF - 2.67
NJ OASDI/EE - 76.40
When I tried filling the NJ 1040NR form, It said, I should not enter the above item deductions sum in the 44 th line
44. Total New Jersey Income Tax Withheld (From enclosed Forms W-2 and 1099) . . .
--------------------------------------------------------------------
From Instructions ----- Do not include on Line 44 amounts withheld as New Jersey unemployment insurance/ workforce development partnership fund/supplemental workforce fund contributions (shown on the W-2 as UI/WF/SWF, if combined, or UI, WF,
and SWF, if stated separately) or New Jersey disability insurance contributions (may be shown as DI). These are not New Jersey income tax withholdings and may not be used as credits on Line 44.
-----------------------------------------------------------------------------------------------------
Then I tried to entre the above amount in the 47 & 48 th lines
47. EXCESS NJ UI/WF/SWF Withheld (Enclose Form NJ-2450. See Instructions) . . . . 47
48. EXCESS NJ Disability Insurance Withheld (Enclose Form NJ-2450. See Instructions)
--------------------------------------------------------------------
But the Instructions said ------
If any single employer withheld more than the maximum for either UI/WF/SWF ($113.06) or disability insurance ($133.00) contributions, enter only the maximum amount for that category on Form NJ-2450.
--------------------------------------------------------------------
Am I eligible for the refund of the above items if I file a NJ 1040 NR? Also will these deductions stiop if I Fax a NJ-165 to my employer?
Per paycheck an amount of $25 is being cut as the above NJ deductions. Really curious to know if I could get refund for these deductiosn, Please help -

Voting Question: appealing unemployment in NJ?
(Mon, 15 Sep 2008 15:33:19 GMT)
My husband got denied unemployment. He was on disability until 7/13/2008. He broke his ankle in May. His company CVS/Pharmacy informed him that he was going to be granted a leave of absence. His manager told him don't worry he was going to take care of it. In the middle of his disability his insurance/benefits were terminated and he got a letter stating his leave of absence was denied as well. After his disability was over he filed for unemployment. They denied him stating he failed to inform employer after his disability. A co-worker stated that the district manager was telling people that he "wasn't coming back" he never said that he wasn't. We want to file an appeal because it's not fair. He is able to work now. He has worked for 10 years, he has paid into unemployment all his working career, how is this fair? Has anyone filed an appeal before?? I need help.

Resolved Question: Unemployment in NJ...how does this work?
(Thu, 11 Sep 2008 18:45:54 GMT)
My fiance broke his ankle. He went to work and they told him you cannot work. That he will get short term disabilty. He went to the doctor and told him he had to be out for a few months. His job did not give him the short term disability because he did not enroll so he went through the state. His employer filled out the paper and he got the state disability. He then was denied for leave of absence and the employer was suppose to write and help him get it because it was for a good cause, he was in a cast. They never did that so in the middle of his disability at the doctors he no longer had insurance, they cut him off. His manager never called him or anything, then told other employees he wasn't coming back??? He never said that. Now he is trying to get unemployment and the company is fighting it. He had a telephone interview and is awaiting the results. Isn't this a good cause?? I mean should he get the unemployment??

Resolved Question: Fired for Being Pregnant, want to know a reasonable "reward" to ask for?
(Fri, 16 May 2008 23:47:41 GMT)
My doctor made me go out on temporary disability when I was 14 weeks pregnant due to anxiety. My employer approved, filled out my disability papers and the last I had heard, we were going to "meet" about the what we were going to do while I was on disability. I received a letter ONE WEEK later stating that they were firing me because I couldn't take prescribed medication due to my pregnancy. I lost my benefits, my job and my disability insurance. I had to apply for unemployment, and it turns out I was cleared to return to work after being out for only 5 weeks. Now when I applied for unemployment, the state approved me and I now received a letter saying that the employer is appealing it. I already have filed a lawsuit with an attorney, due to the fact that they violated more than 6 NJ state laws. They appealed my unemplyment before they even knew that I was suing them. It is a franchise, multimillion dollar company, and I really would like to know how much I should settle for. Thnx!
lexapro. it was a very stressful job and after the birth of my 1st son i had really bad anxiety. although once i was on the medication i was fine, when i found out i was pregnant my ob said i can't take them. so the anxiety was overwhelming, i needed a "sanity break", as my doctor said.
she seems to think we can get at least 1/2 a mil, but i want to make sure that it is reasonable... punitive damages for violating 6 laws, plus my wages plus anguish plus marital interuption... a lot of stuff
number 1 i am a manager. 2, it was cause i was pregnant, bc i couldn't take the medication DUE TO MY PREGNANCY. in nj you can apply for disability for up to 12 weeks, so how is that fair? bc i am disabled i get fired?
unfortunately w/o finishing college, making 6 figures without a degree is hard to do and i found a job that helped my family in that way. we lost more than 65% of our families income. my husband is a teacher, not a millionaire. so i couldn't just find another job, it was an opportunity that i had to take for my family.
Actually they sent me a CERTIFIED LETTER saying they were firing me cause of my disability caused by my pregnancy.

Resolved Question: Employer terminating job while on temp. Disability in NJ?
(Thu, 17 Jan 2008 21:26:00 GMT)
I am out of work on my doctors recommendation and on NJ State Temporary Disability Insurance. After being on medical leave for 3 wks. my employer Terminated my employment indicating I have exceeded my allowed amount of time off. They make it sound like I am on vacation or something! They also indicated I should contact them them upon my release back to work for a list of open positions available with them. This seems illegal from any research I came upon within NJ state guide lines. Is this legal for the employer to do?? It seems to me I was terminated so they are not responsible to pay for part of my Medical Insurance. Any info will be greatly appreciated. "C" in NJ.

Resolved Question: How much monthly benefit do you need when applying for a disability income insurance?
(Wed, 24 Jan 2007 20:51:21 GMT)
I was told as an example, if I gross $6000. Take 80% of that and subtract $2100 to get $2700.
The $2100 is the monthly disability benefits I would get from my state (NJ). True?
