Open Question: Do you think I would be eligible for disability?
(Wed, 17 Mar 2010 17:11:46 GMT)
Alright, I really didn't want to have to resort to this, but my husband works construction and has been off 2-3 days weekly for the last couple of months due to weather, and I really think if I were eligible it would supplement his income greatly. Since I am without any type of insurance, I haven't been to the doctor about these things recently. I really didn't want to accrue a lot of medical debts because we will be trying to purchase a house within the next 2 years. Anyway, I will list what my symptoms are and I would like you guys to let me know if you think I would qualify for disability. Carpal Tunnel Syndrome: I've never been officially diagnosed with CTS, but I've only been to the doctor for it once a few years ago (so that could be why). The time I went I was given a cortisone shot in the wrist. In my right wrist, I often feel pain. I wake up at night with most of my right hand completely numb and the finger next to my pinkie is so numb it's painful. Sometimes it wakes me up 3 or 4 times a night and it usually takes me 10 minutes or more to get my hand to lose enough numbness that I can go back to sleep. When it's really bad, I have a hard time lifting things the next day. Chronic Back Pain: I've had this since I was in high school. If I'm on my feet for more than a couple of hours my back gets really painful. If I bend at the waist and let my upper body hang, I can feel and hear my spine stretching a popping. When I was in high school, my mom would take me to a chiropractor and that seemed to help, but after I turned 18 and was without insurance I stopped going. On my first visit to the chiropractor, he took some x-rays of my spine. I'm no medical expert, but I'm pretty sure your spine should not look like a question mark from the side. Also, I don't know if this is at all related to my spine, but my legs and feet go numb a lot when I'm sitting (when I say a lot, I mean once a day or more). Post Traumatic Stress Disorder: In August of 2006 I had a car accident at an intersection. It totaled my car and made me terrified of certain driving situations. I was unable to drive for a very long time, and even now that I've started driving again, I refrain from going into the cities where there are lot of intersections and stoplights. My husband drives when we go to those places, and if we have to make a left turn, I just look down into my lap, with my hand above my brow to avoid seeing the traffic around me. It's not just intersections though. My husband went to pass someone in a legal passing zone and I ended up having a panic attack. I hyperventilated and began crying. I know it seems extreme, but I can't control it. It just happened. Again, I have not been to the doctor for this. Sometimes I have bouts of depression, but it's not a constant thing. I have been treated for it in the past. I would really like to be treated for these things, but without insurance I feel like I will be stacking up a lot of debt that I don't have to if I just suffer from them. If I did qualify for disability, I would be able to get treatment for these things, which I would appreciate immensely. I would also like to know if my choosing to not go to the doctor every time I have a problem with these things will affect my eligibility. I mean, even when I had insurance while I was pregnant, I still didn't run to the doctor for every little pain. Please, if anyone with experience in this area can tell me what you think, I would be very grateful. For those of you that won't offer any help and just want to complain about people that draw disability, please just skip leaving a comment. All offensive answers will be reported. Thank you in advance for your answers! EDIT: Honestly, I don't need a lot of money from this. Just a little coming in to help when my husband is out of work like he has been. Also, having the insurance they provide would allow me to get treatment when I need it, rather than suffering through the pain when it's really bad. What I'm asking is: Do you think the symptoms I've described would be enough to make me eligible?

Resolved Question: WHO IS ELIGIBLE FOR RETIREMENT BENEFITS? Pension under the Employment Retirement Income Security Act of 1974?
(Thu, 11 Mar 2010 09:03:31 GMT)
My father, 51, had been an hourly worker in a machine shop of for 21 years and four months. On a Christmas holiday, he suffered a severe heart attack and was hospitalized for three weeks. At his release, his doctor said he was to rest at home for a couple of months. After his recuperation period, his doctor, along with his company’s physicians, was to decide whether or not my father should retired for disability reasons. They never got the opportunity to make this decision; in February, my father died of a second heart attack. He left my mother, four sons, two daughters and two-daughters in-law. His wife, my mother, still had four children at home. As part of my father's estate, my mother received the normal group insurance payments, the balance of his savings plan account, and the other benefits due her. However, my mother did not receive a pension from the company as a survivor of an eligible employee. When my mother and the company representatives had discussed the settlement, my mother had inquired about my father's pension and about my mother's right to receive it. The human resource department had stated that since contributions to this fund were made only by the company, no survivor’s benefits were provided. 1.What do you think my mother should do at this point? 2.What does the Employment Retirement Income Security Act of 1974 have to say about this issue?

Resolved Question: financial assistance programs for parents of handicapped children in Ca?
(Tue, 09 Mar 2010 18:37:44 GMT)
I know that a handicapped adult can receive disability insurance, but what about parents who are prevented from working due to caring for a special needs child?? I am trying to get him enrolled in the county special education program, but as anyone who has dealt with the districts knows that it is a nightmare, especially in this economy. Every time I have tried to work, even part time, I have had to quit immediately because I cannot get care for my child, he has been kicked out of every single day care program in the area except for the private special education school, but I can't send him there anymore, it is very very expensive. He is supposed to have his IEP completed as soon as he gets an official "diagnosis" but unfortunately every time I take him for his psych exams/evaluations, I have to pay them a $70 copay and I cannot do it every week, and psych exams take a very long time even if you do go every week. The only place nearby that will do it at no cost has a 6 month waiting list and I do not know what to do for income in the meantime. Are there any financial assistance programs specifically designed to assist parents who are full time caregivers for handicapped children?

Voting Question: Trouble e-filing because of box 1 being empty?
(Thu, 04 Mar 2010 04:53:25 GMT)
My wife received a W2 from her insurance company that paid her disability income while she was on maternity leave. There is nothing listed in box 1 under wages, tips, and other comp. Box 2 and box 17 both have $237.14 withheld. Box 13 is checked for "third-party sick pay" and box 12J is showing $5572.86 of non-taxable income. I tried including this W2 but due to it showing 0 in box 1 it will not allow me to file electronically. What is the best course of action for this particular w-2 and filing it? You can not e-file if box 1 is $0

Resolved Question: Divorce and dependents?
(Mon, 01 Mar 2010 00:32:17 GMT)
My spouse and I have been living separately for 12 years (married for a total of 24 years). I am retired on a disability and cannot work. I recieve a disability pension which is not taxable. I pay my spouse $400 a month for health insurance through her employer (have done this for the last 12 years), but otherwise we live completely separate lives. I do not own much of anything and she makes much more income than I do. Also, she files her taxes with me as a dependent. Can she realistically argue in this divorce that she needs support payments from me (her "dependent")?

Resolved Question: My Father is Paralyzed From Chest Down and has medicaid but they wont pay for a new wheelchair what can i do?
(Wed, 24 Feb 2010 18:08:30 GMT)
My father was paralyzed in 2008 result of a car wreck. he is now collecting disability and has full medicaid. his mother passed away one year before he was paralyzed leaving behind a Jazzy (electric wheelchair) it is now becoming wore out and he would like to get a new one, but with his only income being disability and only insurance medicaid they wont pay for it, what does he need to do? is there any programs or support out there for him? he lives in Alabama any useful info would be greatly appreciated. thanks! All great suggestions but the scooter store and others like it is for medicare only. he has medicaid not medicare, the only thing they will cover is your everyday wheelchair but considering he is paralyzed from chest down he has no balance or control over holding up his upper body meaning he has to use one hand to hold his self balance and the other to operate the wheelchair. I have spent hours on the phone with medicaid and all they do is give me the run around. call this # and call this # its all bull. I don't know what to tell y'all except don't get injured and not have some sort of insurance cause your government sure ain't gonna take care of you, other than his little nothing of a disability check 647$ a month come on who can live off of that he paid in way more then he's getting out but i guess they considering him being this way for the rest of his life but they wont buy him a wheelchair

Resolved Question: Which social security program needs to be cut or reduced?
(Mon, 22 Feb 2010 15:01:10 GMT)
This system has become another welfare system. Was it suppose to be primarily a social insurance program providing social protection, or protection against socially recognized conditions, which includes poverty...don't we have welfare for this...why are we paying for this twice...through income tax and social security... old age..retirement pension disability...again why are we in the insurance business unemployment and others...why should we pay for unemployment to workers who never put anything in 1. Social Insurance...don't put in...don't get anything out...and legally in this country 2. Retirement Pensions...have to put in to get out...and legally in this country 3. Disability Insurance...has to be regulated...ADHD and behavioral and special education students should not be getting checks... 4. Survivor Benefits...they should only get if their husbands put in and legally in this country 5. Unemployment Insurance...should only get...if they have been paying in and legally in this country 6. Basic Necessities...we already have this service...with Welfare

Resolved Question: what to do, i'm in a terrible situation? :(?
(Sat, 20 Feb 2010 22:04:11 GMT)
i live with my grandparents. they're both 65, they adopted me when i was 2 hoping to give me a better home because my parents got divorced right after they got married, and had a bad relationship, and my mom didn't have a job and couldn't take care of me by herself. i've lived very good so far, i have pretty severe mental problems, but i don't really have to worry because my grandfather's insurance covers the family. well, now my grandparent's are getting divorced. i just found out today. i assume i will be living with my grandmother because she is my blood family. my grandfather made all the money in the house and his insurance covered us. we will have no income and no insurance. i'm very scared right now. i'm very mentally ill, and i don't know what's going to happen to me. i'm going to court for disability in a couple of months but it's so hard to get right now. where are we going to live? my grandmother didn't go to college and is too old to work. what are we going to do? i'm so scared right now. what's going to happen? i feel selfish for thinking about what's going to happen to me, but i'm worried for my health. i have a learning disability, even though it may be hard to believe, i am extremely good at english, i am well written, but i cannot hold a conversation well, i don't talk a lot, and i'm generally lacking in life skills. i have ADHD, i'm bipolar, and i have PTSD. i've been in therapy 10 years. so for everyone who's being an asshole, and telling me to "go get a job..." i can't. wendy's wouldn't even hire me. i don't even know how to act towards my grandmother. so no rude comments...please. i was legally adopted, and i think i'm covered until i'm 23. i am 19 years old, however, my mother AND father told me i am not really welcome with either of them but my biological mother is offering a place to stay, but she too is not on her own two feet yet. she is living with her husband's family and i am engaged! it's such a trying situation...

Voting Question: O.K.....I have another tax question.?
(Mon, 15 Feb 2010 23:58:05 GMT)
On the Wages & Income Section where I put i my part time W-2, it also asks for my Social Security Disability Income. Then asks what do I pay for my Medicare part B and Part d. So I put in there. Then in the Deductions and Credits section where you enter medical expenses, it says Insurance Premiums (including Medicare) So am I suppose to put that in twice? I don't know why after all these years I have just noticed this. Or maybe it is new. I don't know but it just has me a bit confused. do you think Turbo Tax just knows what to do? I know.....duh! Anyway if anyone could shed some light. And thanks sooo much for the HOH answers! ♥ It is from my 1099-SSA from my disability not a W-2. Medicare Part B & Part D premiums.

Resolved Question: Can my parents claim me still as a dependent?
(Sat, 13 Feb 2010 01:09:49 GMT)
My parents told me they have claimed me as a dependent last year at age 24. I am 25 years old now and do not attened school. I am on social security disability income. I have mental disabilities related to a documented brain injury from birth. However I was able to obtain and work two part time jobs last year and made $12,000 aside from having my SSDI benefits. I tried college again for a few months and completed a couple classes then discontinued schooling. I also cover my own medical insurance, vision insurance, medicine and medical needs, hygene products, phone bill and pay them for food and internet $113 a month. I also pay for my own transportation if needed be it a cab for work or for a friend to pick me up. They refuse to accept any rent payments from me. I do my own taxes online with Turbo tax and I will get a large refund from my federal return. I checked the box i can be claimed as a dependent and it went down to $1. That makes me very upset, I have never been able to have a tax return because I have always been claimed by my parents. If anything they should claim my sister who is 15 years old with no job. She doesnt pay for anything and is dependent on them for everything. At least they have a kid they can claim so they should be happy with that. They won't give me a cut if they do claim me, thats sad because I could really use a tax return for things I need. I have been working on trying to re build my credit from years ago and want to put the money towards that to try to better myself financially credit wise. So then I will at least have a chance to get my own place with little or no trouble. So can they still claim me with the infomation I have provided here? If I file before they do and they do claim me then do they have to file an amend x return if I check that I can not be claimed as a dependent and file my return? I was forced to resign and it is considered constructive discharge from my scond job. This year I still have my first job however they are discriminating against me and get less than 10 hours per week. Looking for more work. At least I try to work. Card ron - Even though for last year I made $12,000 more than the $3,000 allowance I read on the IRS website aren't I considered dependent if I have a mental or physical disability that is not temperary lasting? I pay for my own medical and vision costs. Transportation if needed. Some food costs. All they pay for is shelter and food. I pay for everything else on my own. I recieve social security disability because I do have a brain injury that limits life activities frontal lobe damage to be exact. However I am able to still work obviously as I did have two part time jobs last year and I have held my first job for over a year now. Oh and I forgot to mention clothing. When I do go shopping I buy my own clothes with my own money. Unless it is given to me as a gift for special occassions such as a holiday or birthday. How do they prove that they provide more than 50% of my support? How do I prove I support my own transportation, clothing, medical needs, vision, food costs and phone bill? and the fact that I pay them a portion for food and internet out of my money? Do my parents have to know how much I made last year along with social security benefits to prove if they support more than 50% of my support? I would like to keep that infomation confidential as they don't tell me how much their income is. It's only fair.

Resolved Question: can you be thrown in jail if i got no assets debt collectors can take?
(Fri, 12 Feb 2010 03:21:43 GMT)
can you be thrown in jail if you got no assets debt collectors can take. i work a low income job less then 30 hours a week. i receive disability income and i don't make enough to pay my debt and support me myself. i got a call from a collection agency that if i don't pay they will get a lawsuit against me. i don't make enough and now im scared that i will go to jail if i got no assets to take. if i got no assets what do they do? how do debt collectors view what assets i have if i have any at all. all i got is a car i bought locally and is paid in full but i think this is exempt as well as my disability income i researched this this is my research Many people are in fact in a position where they cannot be collected on. If incase you are disabled and/or on limited income, chances are that they can get a judgment but will never be able to collect the debt. There is also a Federal minimum wage pay per week (around 30 hours), which if you make below, they cannot collect. For example, if you make a minimum wage of $5.80 per hour, times 30 hours, comes to $174 per week or $702 /month. If you make equal to that or less they cannot lay a hand on you. Money that is in IRA’s, custodial accounts, trusts, annuities, and insurance contracts are often untouchable. Can my personal property be seized by a Marshal? The following kinds of personal property are exempt from debt collection and cannot be seized: * Household goods, like furniture, clothing, and appliances * One television * Radio * Personal items like wedding ring or watch * If a computer or car is indispensable to your work, they can be exempt as "tools of trade i got both but are they still exempt. i need honest answers i live in Idaho

Resolved Question: Can my ex-husbands wife claim my son on her taxes?
(Wed, 10 Feb 2010 04:10:38 GMT)
My ex-husband and I have a separation agreement that was incorporated into our divorce. It states that we will claim my son on alternating years, however in the event my ex is exempt from filing, that I shall have the right to claim my son. I put this in the agreement because my ex receives social security disability and I knew the likelihood of him being required to file was low, so I tried to protect myself by putting a condition in our agreement. He remarried in 2009. This is his year to claim our son, IF HE IS NOT EXEMPT from filing. He had no income so when he and his new spouse filed taxes, they filed married filing separately and she claimed my son. My ex is not filing a return because he had no income. I am upset by the fact that she claimed my son. I did not release the exemption to her. And since my ex did not file his own return, I feel it is only fair that I claim my son. He spends equal time between us. I do provide greater support for him in that I carry health insurance, etc. I have a higher adjusted gross income than either of them. By reading the IRS rules it appears as though the IRS would rule in my favor. Could someone with some knowledge digest this and let me know if you feel the same way? I could understand if they would have been married filing jointly and had a reason to file. But with them filing separately and her claiming my son, I feel as though she is taking my legal right to the tax benefits of having a child. Thank you for taking the time to read/respond to my questions!

Resolved Question: Veterans Association + Short Term Disability Insurance?
(Sat, 06 Feb 2010 21:01:44 GMT)
My Dad has ALS and was granted Short Term Disability (has to run out before he is eligible for Long Term) and is receiving 60% for of his income. He is also a Vietnam Veteran and was granted 100% benefits from the VA and has been receiving payments from the VA. We were just informed that he may not be eligible to receive both the STD payments and his Veteran's Benefits. Is this correct? The VA told us that he should be able to get both, but the STD provider is telling us that he cannot receive both and that he will have to pay back the difference of of the STD minus the VA benefits (which is rediculous because the VA benefits are double the STD payments). How do I find out what is correct when we are getting conflicting answers?

Resolved Question: Considering bankruptcy - liquidatable assets?
(Wed, 03 Feb 2010 16:10:12 GMT)
I am merely considering this as one of several possible solutions and as a last resort. I have credit card debt and student loan debt that has deferred and gone to collections as of several years ago, totalling upwards of $40k. I have not had steady employment since 2001, and every year since then I have made $10k or less, excepting one year when I made $12k. I am way below the poverty line (Even here in Michigan) and it appears that I do not qualify for Chapter 13 because of my lack of stable income. I've had some health problems including a diagnosis of Fibromyalgia (though as I have no insurance, I have not been in to see a specialist who can give me the diagnosis needed for it to be legally recognized as a disability) which has furthered the cause of not having steady income. In the past 5 years, I have probably worked only a grand total of 3 of those years due to layoffs and firings which has made getting out of debt near impossible. Over the past 15 years I've collected various small assets (mostly christmas presents and birthday presents or stuff bought before I went into debt) including dvds, cds, books, and video games. What I want to know is a) are these considered liquidatable (will I lose them if I file chapter 7) and b) if so, how is their value determined? They are for the most part very common easy to find items. I also inherited a bunch of my grandmother's cheap jewelrey (earrings and the such that were likely purchased for $5 or less each) when she passed away in December of 08. I do own a 1998 Ford Ranger that I use to transport both myself and my brother to our jobs. Will I lose this too? It was completely paid off and is not tied to any of my debts. I have tried CCS in the past, but I lost my job shortly after it and thus was unable to continue with the plan and it did not cover my loan debt, only the credit card debt.

Voting Question: Anyone know some Federal tax questions? Related to combined disability, unemployment, and regular income...?
(Wed, 27 Jan 2010 20:53:45 GMT)
A friend worked only 11 weeks during early 2009 earning just over ten grand. She then had a serious knee operation and went onto puny company funded 710 dollars a month short term disability for 6 months. finally, she got some unemployment payments for a few months. This was in NY State. Of course, she had a lot of out of pocket med costs for MD visits, tests, physical therapy, travel, phone, other medical payments which total up, plus some other deductibles if she files the long form with miscellaneous deductions... in NY. How does all this figure on both Federal tax returns as well as NY State tax dept. returns? Does the unemployment insurance count as regular income dollar for dollar....what about the short term disability payments? Any Special things and forms to do/use?

Voting Question: Social Security Double Benefits?
(Tue, 26 Jan 2010 19:26:50 GMT)
I would like to get information on how is it that some people can get DOUBLE benefits. For example I know a few people that get Social Security Disability Insurance (SSDI), which is based on prior work under Social Security, and Supplemental Security Income (SSI), these payments are made on the basis of financial need. I like to get some information…

Resolved Question: Should I file for bankruptcy? Do I really have another option?
(Tue, 19 Jan 2010 18:44:11 GMT)
Right now my husband and I are living on his income and private disability through my previous job. We are just making it. My disability runs out in July. I have been rejected for social security disability, which is really common for your 1st attempt in Michigan. I have an attorney to appeal, but I found out that it takes 2 years. This means in 6 months our income after tax will be anywhere from $1,500 to $1,800 per month. Our student loans, car payments, insurance, healthcare, tools for husband's job and medication add up to $1150 a month. Our rent is around $700. Once you add our credit card debt, which is $300 a month, we owe $2,150 a month. THIS DOESN'T INCLUDE FOOD, GAS, OR DAILY NECESSITIES! I do not see another option than bankruptcy. Personally,I am most afraid that if we do declare bankruptcy I will lose my wedding ring. It was paid for on one of the credit cards with the highest balance, or I would try to pay that one off right away. I paid $2,700 for it. Anyone had any experiences with this, who can share some of the benefits and drawbacks? Can I declare bankruptcy without effecting my husband? Although, I appreciate money-saving tips, the bottom line is that our bills alone are more than our income, without including groceries, entertainment, etc. Of course there are things we could cut down on, that's why I have only given information as to what we have to pay every month. We are looking for a cheaper place, but $700 includes all utilities. This is a standard rate in our area for 2 people. Public transit is so limited that it is not a realistic option where we live, unfortunately. As far as my health costs. I have written that I am on disability so I don't I really need to explain those. Those are my out of pocket costs after insurance which I included when calculating our net income.

Voting Question: what should i do when my husband can't be empathetic?
(Tue, 19 Jan 2010 14:36:29 GMT)
Our marriage is in trouble because I'm physically ill. I have always been a very active person and always had something or some art project going on. We used to very sexually active and always affectionate. Some of my issues are due to my being 45 yrs. old and he says he understands that women have issues at this point in their lives. For the past year, I have been experiencing pelvic pain daily and do my best to function with juggling over-the-counter pain meds, tub soaking, heating pad, yoga etc. We live on his disability income and a few months ago, we were finally able to get health insurance for me. I am currently awaiting blood test results and more pelvic ultrasounds to find the source of the pain from the gyno and gastroenterologist. He tells me "I just want you fixed" and “I want my wife back”. He makes comments about me not being the person I was, but insists that he understands and still loves me. I don't just want his sympathy, but some compassion and empathy. He has practically stopped even being affectionate because he says he doesn't want to cause me more pain. The pelvic pain i have during and after intercourse causes me to be in bed for a couple of days afterwards. I have tried different forms of intimacy other than penetration, but he gets worked up to the point that it’s just not enough for him. Since I have been having pain, I haven’t been able to satisfy him sexually and it has become a serious problem for him. He has even told me that he is never truly satisfied, even with penetration. I have suggested marital counseling, but he says he will not even consider sharing this with anyone. I’ve read library books and did some internet research, but he’s not interested in talking about what I find and what I have found seems to be ineffective or inadequate for my situation. I have lost his affection and fear that I will lose him completely. He doesn’t want a “broken wife”. I would try anything to make us better. If anyone out there has any suggestions, I would appreciate your help.

Resolved Question: Does type 1 diabetes qualify you for SSD or SSI?
(Thu, 14 Jan 2010 18:45:35 GMT)
My husband has had diabetes since he was very young. He has been layed off work for over a year now and I am also unemployed. Our only income are his unemployment checks. He has no insurance and we cannot regularly afford insulin (he needs 2 vials a month), test strips, syringes or doctors visits and his health is rapidly deteriorating. We applyed for medi-cal but they said he makes too much on unemployment and gave us a share of cost. He is constantly looking for a job but the only ones he can get call backs for dont pay more than unemployment and wont pay the bills, he is getting sicker. My question is, will my husband qualify for Social Security Disability or Social Security Insurance based on his type 1 diabetes? And if a person does qualify, does SSD or SSI cover medical needs? We are young and invision so much better for ourselves than a life on social security but we have to do something to make it through this rough economy and lack of health care.

Resolved Question: Terminal Illness and Debt?
(Thu, 14 Jan 2010 01:26:15 GMT)
My father (53) has a terminal illness (he's almost a year into a 3 months to a year prognosis). While he thinks he still has years, the reality is that it's more likely less than a year. Over the years, he has manage to get himself into at least $75K of consumer debt and $9K of CRA debt. He is single and rents. The only assets he has is approximately $55K in lock-in RSPs. His income is approx. $5K/month (Disability CPP and non-taxable disability insurance). The debt is really weighing him down, and he has been paying approx. $3K/month towards it (well over minimum payments). However, he also wants to be able to live the best life he can. He's thinking of bankruptcy and wanted to find out what other options he has. Any suggestions?

Resolved Question: I am changing insurance plans, and have been working hard to use Valium, (Diazepam is generic equivelent.?
(Tue, 12 Jan 2010 14:28:10 GMT)
I used to take Klonopin because I had bad panic attacks and became agoraphobic. Now that's coming back. I usually go out only for grocery shopping when I have to, and take a State of Connecticut Transit van for disabled people. I also know about Ativan, (lorazepam) but haven't used it hardly at all. Also a few years ago I was prescribed Xanax which also helped my depression. Can anyone give thier opinion as to which I may have to switch to, I need to speak to my psychiatrist, who mainly writes meds., TO KEEP HIM UP TO DATE. I don't abuse my meds and do not drink alcohol because of dangerous interactions, PLEASE HELP!!! Thanks Thanks if anyone can help me find something I can afford, and I'm looking for a pharmacy that delivers to my home in Hartford, CT, so I don't have to spend money I don't have to pick up my rx's. Thanks for your help, I'm having a really tough time, I have severe depression, recurrent, with anxiety, since I was 17, and am now 58, almost 59.. I know I can become tolerant of any sedative-hypnotics, but until I can replace my Therapist of 12 years, I will need something for a while that I can hopefully "taper off" from! I don't get enough income from disability to allow for the full price of anything (I have other reasons for disability, like bad arthritis throughout my entire spine, lesser arthritis other places, and the beginning of rheumatoid arthritis. No one will prescribe me any pain medication, and I've done the steroid shots and surgery on my back for spinal stenosis, from which I contracted MRSA and had to stay in a nursing home for a month for antibiotic IV's. and it ASN'T UNTIL MY BACK NEVER GOT BETTER THAT THE NEUROSURGEON HAD AN mri DONE WITH THE DYE, AND THAT'S WHEN HE TOLD ME THERE'S NOTHING THAT CAN BE DONE FOR MY SPINE.

Resolved Question: Why are people so hard on pregnant women who need to apply for assitance?
(Thu, 07 Jan 2010 19:29:02 GMT)
Your Question Why say the women who are pregnant and seeking assitance are gov't leeches? When someone mentions applying for assistance, why are people all b***** about it and assume automatically that they are wh0res,sl**s,and want to leech from the government? In these hard times, more people are having to apply for help to survive. My children are on medicaid because I can't afford to get them another type of health insurance. My husband works a great job,and I'm unable to work because of a disability I have. Why are people so mean, because not all women get pregnant to get the assistance and leech from the government. We've had to apply for food stamps and all that before, but when we DID NOT NEED THEM ANYMORE,we stopped using them. Why all the meanness towards pregnant women that are looking for income help? you all want to yell "no no no don't have an abortion" but THEN yell "NO don't apply for assistance, taxpayers shouldn't pay for your children". Yet you want the mothers to keep all of their children. Kinda hypocritcal don't you think? yea um the only assitance I get at the moment is medicaid for my kids. The disability I have actually does NOT make it hard to care for my children, but there are reasons behind me not being able to work. Like the fact that my short term memory is screwed. I have severe emotional issues where even my thereapist/doctors are saying i don't need to be in the workplace environment. Mandi-No,you are not being hormonal in the slightest!! It irritates me to death that people won't realize that they have it so easy, and don't have to worry about assitance. I'm not white trash or a loser either,it's not my fault that stuff is how it is. We make enough to barely scrape by between my husband and I both. I don't get very much income, and we do our best. I can relate totally to the low on cash thing, because at this point,it's nowing like a ***** here, and I can't get my son any formula b/c I'm sick and can't talk at all,so can't call my husband at work and have him get formula. The money thing,we'd have to borrow a bit of money to even be able to get it,but I'd rather do that than have him go without, and I'm worried he's going to go without because I can't call my husband at work!! Yes HollyM,you understood what I was saying perfectly!! Sometimes the situations can't be avoided, but for God's sake,if you're already on medicaid through the government, why not get birth control,ya know? The women who get pregnant while on it,that's a different story. Because medicaid will 9/10 times cover the costs of pregnancy prevention!!

I don't think it's bad at all for people to apply for assitance if they need it and aren't doing it just to leech so they can use their money on other things and whatnot. Yes JamalB,I agree with you. My mom and dad are facing this right now. My dad worked for a long time for a company, got laid off,and they won't give them anything!! They're barely making ends meat with the income they do have, and my mom's working and my dad is collecting his unemployment because nowhere will hire him!! And yes,the women collecting assitance and then getting knocked up WHILE ON IT are just idiots, because medicaid WILL cover birth control!!

Resolved Question: I'm 19, out of state, and have a toothache. What can I do considering my insurance ?
(Thu, 07 Jan 2010 17:24:04 GMT)
I'm a 19 year old male who lives at home with my family in central Florida. I guess you could say we are a low income family since both my parents are on disability. I currently have medicaid and my insurance is called StayWell. Right now I am temporarily staying with an Aunt in New Jersey and I have a very bad toothache in my molar. There is a visible abscess in my gum/jaw and I'm a bit worried. I'm not sure when I am returning home and I really need to take care of this ASAP because it hurts very bad. I'm pretty sure my insurance is only good in FL, so I don't know what i can do. I was thinking of going to the ER and see if they can just pull out my tooth, but I don't know if they can do that. So I'm not sure what my options are at this point... anyone know what I can do ??

Resolved Question: How will illegals improve America with millions of Americans forced to Living on Nothing but Food Stamps?
(Mon, 04 Jan 2010 22:48:21 GMT)
How will illegals improve America with millions of Americans forced to Living on Nothing but Food Stamps how are illegal Mexicans expected to boost anything when our own citizens cannot find work, no jobs out there, but we need 20 million illegal Mexicans here, for what ?CAPE CORAL, Fla. — After an improbable rise from the Bronx projects to a job selling Gulf Coast homes, Isabel Bermudez lost it all to an epic housing bust — the six-figure income, the house with the pool and the investment property. Now, as she papers the county with résumés and girds herself for rejection, she is supporting two daughters on an income that inspires a double take: zero dollars in monthly cash and a few hundred dollars in food stamps. With food-stamp use at a record high and surging by the day, Ms. Bermudez belongs to an overlooked subgroup that is growing especially fast: recipients with no cash income. About six million Americans receiving food stamps report they have no other income, according to an analysis of state data collected by The New York Times. In declarations that states verify and the federal government audits, they described themselves as unemployed and receiving no cash aid — no welfare, no unemployment insurance, and no pensions, child support or disability pay. Their numbers were rising before the recession as tougher welfare laws made it harder for poor people to get cash aid, but they have soared by about 50 percent over the past two years. About one in 50 Americans now lives in a household with a reported income that consists of nothing but a food-stamp card. http://www.nytimes.com/2010/01/03/us/03foodstamps.html?pagewanted=1&hp

Resolved Question: Is this person eligible for disability or medicaid?
(Mon, 04 Jan 2010 22:39:03 GMT)
The woman didn't work; she was a stay-at-home mom. However, she now has multiple health problems at 61, and a hospital superbug caused her to lose both of her artificial knees. She can no longer walk. She is in and out of the hospital all the time with infections related to the superbug. The health insurance her husband pays is $1600 a month. A family member recently said that she may be eligible for some help with her healthcare bills with medicaid. She is not looking to collect disability for income because her husband supports her, but rather get some type of help with her medical bills with medicare or medicaid. Her insurance payments are causing her and her husband to live on rice & beans and barely meet their bills. They are really struggling. Any advice? Or does she have to wait until she's 65 and just try to scrape by losing everything she has while waiting the next 4 years? The insurance company keeps raising her monthly payments!

Resolved Question: Do I file taxes when my income is from disability?
(Sun, 03 Jan 2010 23:50:28 GMT)
To explain: I don't get social security, what I have is through the state (I'm in Washington state). It's called GAX. They provide me with $200 a month and medical insurance. What I'm wondering is, do I file taxes this year? This is the first year I haven't worked at all, so I'm a little confused as to what to do. I see lots of sites about what to do if you have social security or veteran's benefits and so forth, but I'm not on those. My father is pushing me to find out about filing because this is the first year I would be eligible for the Earned Income Credit, being over 25 now. However, I don't really believe I've earned anything this year. I'd appreciate any help I could get. Thank you in advance! Thank you Mathew! I kind of thought that was correct, but since they sent me a thing today about the EIC with my insurance coupon, I thought I'd ask.

Resolved Question: opinions wanted - writing a will, can't split estate fairly, what to do?
(Sun, 03 Jan 2010 01:56:25 GMT)
My husband needs to write a will, but almost all his assets are tied up in one large parcel of land. He has 5 kids, 2 sons, 3 daughters. Only the sons are interested in the property - the daughters have never shown any interest in this land, never camped, hunted or hiked on it in the 35 years he has owned it. One of his sons has been seriously untrustworthy in the past and cut his father out of his life for about 10 years, and has only been friendly the past year or so and is all of a sudden asking about what will happen to the property. well, all the kids are worried, because he had a mild stroke last year. financially, none of the children need help, they all have good jobs and nice homes. I am his second wife and MUCH younger, the same age as his eldest son, and am disabled and without him, am not financially stable (would be low income). (actually, he depends on my income, too, he is asset rich and income poor). We have been together since 2002, and married since 2004. There is not much money besides this acreage, and our home is a dive and needs to be fixed up (not been remodeled since 1950, really, really bad). We drive cars with over 200,000 miles on them, and 1/4 of our income goes to medical bills. So we can't save money to give to the daughters if he doesn't leave the land to them, but they have no interest in this land at all so there is no point in doing that, either. His life insurance is only enough for a funeral. The 80 acres means a lot to me, since I hunt and camp there with my husband, and he would like his friends to still be able to hunt there if he dies first. I don't see a way to guarantee that unless I am left as a co-owner of that land, but I don't want everybody up in arms if he dies before me and attacking me. I would be sure to leave the land in MY will to his family - I have no children of my own, but he can't actually stipulate that in his will, what I do with my share of the land if it goes partially to me. I get along with most of his kids most excellently, but who knows? I have bipolar disorder (that's my disability) and will probably end up in the mental hospital for awhile if he dies before I do. I really wish we could think of a fair way to do this, but I would resent it if we scraped by even worse than we are to give more money to his daughters, who all have nice homes and new cars and we live like crap. But I love his daughters (well, 2 of them) and these 2 have a fabulous relationship with their dad. Just not the land. Is there any good solution here? It's kinda like the family farm situation, when there are no other assets. Wanta make it fair, but how? He's too old to get affordable insurance (and we can't afford it anyhow). He really, really wants the land to stay in the family and not be sold off. So he doesn't want the land sold off and the money split up. Oh, and we will see an attorney, but I just wanted to get opinions.

Resolved Question: Should we get married? Insurance Vs Molina Medicaid?
(Mon, 28 Dec 2009 13:32:26 GMT)
My roommate and I found our that she's pregnant. She's disabled and is unable to work so she receives disability income and has Molina Medicaid. Well I'm about to be a father, which I'm excited about but she doesn't want to rely completely on me, she wants to be able to take care of the child as well. (So she doesn't want to get married and be placed on my insurance) Will her Molina Medicaid cover the necessary pregnancy expenses and all of the appointments? Also if we're not married how do I gain any connection to my child. I can understand how she wants to contribute and be semi-self reliant, I'm just concerned about the baby.

Voting Question: ** HELP ** Anyone who has Degenerative Disk Disease / Rheumatoid Arthritis Did you qualify for Disability ?
(Wed, 23 Dec 2009 03:05:13 GMT)
So Now I have seen my new GP 2x. Dr. M is a compassionate Dr. making time for me to ask as many ?'s as I need to. BUT... i just would like to hear from ANYONE out there if they have been RECENTLY diagnosed w/ DDD or advanced RA... I started out on 2x 75 mg Voltaren (Nsaid drug) and 2x 100 mg Gabapentin... That merely took the edge off of the pain in my back and right leg. Today he upped the dosage on the Gabapentin to 8x 100 mg. I realize that's NOT a high dosage for these meds. BUT i am concerned that's quite a bit to be upped by... I have a follow up in two weeks and again two weeks after that appt. I am also being fitted for a Soft Lumbar Corset in mid~January. I am taking Calcium supplements as I am Lactose Intolerant. Hopefully in the next 2 weeks, I'll adjust to the med increase and have more flexibility and not be so stiff all of the time... I am hoping to get the referral to the pain mgmt clinic here soon. but apparently i need to be monitored the 1st 90 days as I am a new patient of his. Now because this is a life~long condition that can be managed but not cured, where does that leave me insurance wise or in regards to sickness / disability benefits?!? (btw I am CANADIAN) From here on out it is considered to be a pre~existing condition. So what am i obligated to tell a potential employer?!? I lost my job last year, my EI benefits ran out and i have been on Employment and Income Assistance benefits for months now. To cover all of my medical expenses (more than a few hundred $$$ / month) So while i am NOT employable at the moment, i will be Limited asto what i can and cannot do in the future. Based in part on how high a dosage of meds i'll be on and what my physical limitations will be at that time. I understand his policy to monitor a patient for the first 90 days, before even considering signing off on a potential disability claim. But my case worker is pushing for me to apply for it, since it will mean that i will have better medical coverage and a higher benefit rate. And instead of having to do paperwork each and every month/other month... I'd only have to submit 2/3x yr. Anyone out there who has been through this or knows someone who has ?!? Debbie... I don't suppose you'd happen to know where i can find the updated requirements ?!? I was pre~qualified for CPP benefits because i've been on med leave for more than a year. (but CPP does NOT cover month to month medical /Rx costs) Which is why I never applied for it. My disablility ins thru my bank denied me as it one of those non~covered conditions (generally associted w/ natural wear and tear/aging) Which i find a lil amusing considering i just turned 36. EIA will provide another 6 mths of benefits without needing further evaluations. As I am under strict monitoring for the meds I am on. It's just taht i do not want to find myself w/out a back up plan so to speak. If I take my CPP benefits I'd be severely impacting my potential retirement benefits down the line (assuming CPP exists in 30 yrs time) I'm a single parent and i am JUST making ends meet. I'd rather not find myself in a situation where the kids and I lose everyhting I've busted my a$$ for all these years.

Resolved Question: Are there advocates or agencies who assist a clmt in the repaying overpayment of private disability benefits?
(Tue, 22 Dec 2009 21:44:28 GMT)
I worked for The Hartford Insurance company when I became totally impaired. Although I signed a Authorization form for them to communicate with Social Security, they now indicate I have been overpaid $40,000 and must repay it. I believe at least 1/2 of the liability is theirs as the dropped the ball by letting my claim sit for 2 years and then suddenly writing that I owe them this large sum of money. I live on a fixed income as they have already, without notice, lowered my payment by $1000. Now I need to appeal so they do not cease monthly payments to me altogether. I am able to write an appeal but would like some pointers and assistance perhaps by an advocate for the disabled or a company that assists a person with this type of situation by intervening on the behalf of the claimant with the insurance company. Any ideas or referrals? Thanks for your help.

Resolved Question: MEDI-CAL -- doesn EDD-Disability (California) income disqualify?
(Mon, 21 Dec 2009 18:01:21 GMT)
Applying for Medi-CAL for someone under 50. 39 y.o. male friend had a debilitating stroke. He had a job but had NO health insurance. Applying for Medi-CAL to cover astronomical hospital bills (he is still there months later). Will applying for and receiving "EDD- Disability" disqualify him from Medi-CAL? The benefits look to be about $800/week! Does that disqualify from Medi-CAL?

Resolved Question: Can a person on social security disability insurance charge rent to housemates?
(Mon, 21 Dec 2009 06:57:02 GMT)
My brother lives in an older home that he inherited and owns outright. It has 2 extra bedrooms. He is struggling to make ends meet on his benefits, and would like to rent out the extra rooms. If he reduces his actual cost of living by accepting rent and shared utility funds, would SS reduce his benefits? (The rental income would be below maximum allowable earnings, so we are not concerned on that point). Thank you, it's a nice thought, but everything he does is monitored. This is the reason I'm asking here before going to SS. Thanks folks, I really appreciate your answers, but the question is not about the income. It's below the allowable limit and will not be an issue. We are not concerned about this. The question is about whether his SSDI will change based on the change in his actual monthly cost of living, due to the change in living arrangements. His living expenses will decrease - will this cause his benefits to decrease?

Resolved Question: Pregnant in California, currently on unemployment, can I still get benefits?
(Fri, 18 Dec 2009 16:35:00 GMT)
I was laid-off in June from my job (in CA), started collecting unemployment, am now pregnant and due in April. While I have been laid off I have worked as an independent contractor part time so I receive my own income from that and smaller checks from my unemployment benefits to "fill the gaps" in my income. When I am no longer able to work as an independent contractor in April, can I collect disability insurance or unemployment insurance benefits? I have been trying to research this but since my situation is a bit complicated I haven't found any solid answers, any input whatsoever would be very much appreciated!

Resolved Question: Speeding ticket questions?
(Wed, 16 Dec 2009 23:10:09 GMT)
Yesterday, I had just got out of school for Christmas break. I had no final tests to take, and was admittedly thrilled at the thought of freedom. I have senior permit the last period of the day, so school was still in session at the time that I left. I was pulled over for going 50 in a 35 mph school zone (I completely forgot that school was still going on since I was excited about leaving) and subsequently received a traffic citation. This is my second citation this year, so I cannot take defensive driving to avoid the citation appearing on my driving record. I had considered attempting to make an appointment with the judge, hoping to explain my position (both of my parents are disabled, I pay for my gas and insurance by working a minimum wage job while laboring away in AP classes, it's near Christmas time, etc.) to him. However, when I called the number on the citation paper, the receptionist/secretary said that the only way to speak with a judge is to plead guilty, and he cannot change fines. For the record, the judge is in precinct #4 in Amarillo, TX. Basically, the root of my question is, is there any way I can avoid this ticket appearing on my record? Some points of interest: -The speed recorded for my citation was actually incorrect; the officer stated that I was going 50, I was actually going closer to 70. However, the sheriff felt that he would give me a small break, I suppose. (>_<) -The speed in the area that I was pulled over is usually 55 mph -My parents are 100% dependent upon the government for income, due to their disabilities. Any help or advice would be much appreciated. I should add that I am 17, and this is my high school, not college. Furthermore, I understand the necessity of speed limits, and that they're put in place to protect people. But I also believe that there should be a certain amount of compassion and empathy in the legal system; after all, law enforcement and prosecutors are public servants, are they not? Just a thought. In response to crash consultant: I take full responsibility for what happened, and I am more than willing to pay for the initial ticket. However, I feel that my insurance rates will increase significantly, and that I cannot possibly hope to pay due to the economy and the current time of the year. For instance, my work place is being forced to cut the hours of all of our employees due to the increase in minimum wage, and I cannot work more than five days a week. I am very well aware that I sound like a whiny teenager, and perhaps that that's all I am. But I feel that it is necessary due to my current situation and the situations of my parents.
