will judge make a decision that same day for child custody? I have a court date set for two weeks from now. We had a court date set 4 months ago but my ex was trying to buy some more time with his kids before we went to court so he called child protective services on me 2 weeks before court for false accusations. well he got 4 months out of that and CPS has closed the case not finding any evidence of anything reported ever happening ( cause it never did!!!) so 4 months ago when he called we went to court requesting a continuance for until the cps case was closed and requesting to get a court appointed guardian ad litem since my ex is being selfish not thinking about what is best for the kids. will the judge make a decision that same day as to who gets custody of the children ( 2 of them) since we have the guardian ad litem that will be at court and I think my lawyer is subpoena the CPS worker/records also??? if the judge makes a judgment that day does that mean i get my kids right after that ( if that is what they decide) and move them into my home PS im pretty confident that I have enough evidence to win such as medical neglect, serious financial strain on the other side with electricity being disconnected in the last year. cars repo, and it is obvious that if i get custody they will not be able to pray rent from the money they will be loosing they only want to keep the kids for the money ( government disability checks from dads disability , my child support them having to pay child support and pay for health insurance. ) not to mention scaring the kids to think that they will get in trouble if they tell us their step mom has a job. the kid sand 5 and 6 and are always scared they will tell me something they are not allowed to tell me that is just wrong. I go meet with my lawyer next week for pre trial meeting but im just curious from your experience also I have a lawyer and ex is representing him self. actually i dont make more im a stay at home mom so my income is only 400 a month from one child i care for. I dont see how medical neglect and lying to the kids mother about their medical care is a good thing. i am going for joint custody but with them living under my roof with me in charge of medical and school. and him have1,3,5th weekends and thursdays he is the one that wants to keep me from seeing them im asking since we go to court on a wed and the kids last day of school before christmas vacation and the end of the semester is that friday I would really like my kids to finish the semester at the current school since they will have christmas parties and all that stuff. it wouldnt be fair for the kids to be so excited about going to their christmas party at school then get taken from their school the day before. it would be a better transition. and they live an hour and half away so realisitcally speaking me taking them to school each morning and picking them up wouldnt be best that would have my kids waking up at 4 am just for school that starts at 730 and we wouldnt get home til after 6 from scholol tha tgets out at a little before 3

do guardian ad litems usually recommend 50/50 custody? in a case where both parents love their kids but one parents home may be slightly bigger and more room and less cluttered and has safety gates cabinet latches and all that stuff. that parent and spouse have 2 cars pay their bills on time , no government assistance and in general are financially stable and have a pretty good family support network that the kids see grandparents and such with then the other parent currently has custody but they have a small single wide mobile home for 2 adults and 4 kids, a cluttered house (not dirty with food everywhere just lots of junk) continues to get cars repossessed, has had elec turned off, eviction notice for not paying rent, gets food donations from church since cant afford food at times has phone and cable turned off cause cant pay bill. also don't take kids to dr cause they cant pay the co-pmt for the visit or for medications nor if they don't have a car at the time cant get there. also have lied to other parent saying they took child to dr when child was ill but medical records prove that they never did take the child to the dr like they said. and 2 year old had cavities and knew knew but didn't get them fixed while on medicaid ( free to fix) and when the child was almost 5 child complains about teeth parent still wont take them since now child is on other parents insurance so would have co pmts they cant afford. and when gets notice saying they are being taken to court for child custody they finally take child to dentist and dentist says child now has 3 cavities and no signs of previous dental work so that is proof they never took care of previous cavities when child was 2. and parent recently had a transplant is on disability. in neither house is there any drugs, smoking or alcohol, don't think kids are being beaten but get a little more physical discipline than they should but one child has said they get hit in mouth if they say something bad with the parent that cant pay the bills. would you think a guardian ad litem would recommend 50/50 custody? I know they are there for what is best for the kids and it is usually best to spend equal time with both parents so would they recommend this in this situation first off im not the one doing the robbing im the one being robbed. and im the one that has recomended mediation to come to a mutual agreement but other parent just says they should be with them and me only every other weekend. i want my kids to have both parents and step parents that care about them not just care about hurting parents feeligns that is actually what i am requesting is them get everyother weekend, shared holidays and i even added easter adn 4th july so its fare since one parent usually has that holiday fall during their time and the other never gets kids for that holiday. and they get atleast a month in the summer and every friday evening well I live in a mobile home just a larger one so im not dissing him for that. the transplant is not why he cant afford anything sicne well before the transplant he kept quiting jobs and refused to work cause he didnt make enough money. and i think i am being quite nice seeing as i was 15 and he 24 when i got pregnant and he was a adult that should have know better than to take sexual advantage of a troubled teen. the kids are happy kids and knwo both parents and step parents love them but they dont like it that their dad just lays in bed playing video games all the time and will not play with them or take them to the park when he is a stay at home dad. RESPONSIBLE PARENT WOULD SEEK MEDICAL AND DENTAL CARE WHEN NEEDED EVEN IF THEY HAD TO EAT OUT LESS TO PAY FOR IT. SORRY BUT MEDICAL NEGLECT IS NOT BEING A LOVING PARENT WHEN YOUR CHILD IS CRYING FOR A WEEK STRAIGHT WITH A PAINFUL EAR INFECTION AND YOU DO NOTHING ABOUT IT. !!! SORRY BUT HIS $150 A MONTH IN DISABILITY FOR THE KIDS ENDS THIS MONTH THAT IS PART OF THE REASON IM TRYING OT GET THE KIDS SINCE HE HAS NO MORE DISABILITY AND WILL NOT EVEN START TO LOOK FOR A JOB. HOW WILL HE PROVIDE FOOD FOR THE KIDS SITTING ON HIS BUTT PLAYING VIDEO GAMES.

Do you think car may been repossessed? first off im in a custody battle with my kids dad over my 5 and 6 year old kids. about 3 months ago he with out car insurance wrecked his car. it was pushed in on the side front didn't seam to be on the front of the car just the front side. well last weekend the kids told me that their car was in the shop. this weekend they told me it was still in the shop. they told me their dad said it was in the shop to" fix the bump" it has been over a week now at least and they still have to get rides from friends to take the 4 kids to the store and church and all that they tell me that their step mom (only working parent in the house) has not been to work since the car went in the shop. their is no city bus. ( she may have just quit since she hates her job) and has a history or quiting I know that their disability check for my ex either just stopped or should be stopping soon. i am thinking that their car may have been repossessed since they have had at least 2 or 3 cars repo in the last 2-3 years on top of other things happening since they cant pay them such as elec turned off eviction notice ( income tax paid that so they didn't get evicted) etc what do you think the chance of it taking over a week to fix a dent in the car and the busted headlight. i know it took 3-4 days max to fix other cars i have see in the past. i go meet with the guardian ad litem that i requested the court appoint us ( since he is not thinking best interest of the kids) and i just want to make sure i will not be telling him this if it is not possibly true we dont think it is really in the shop we think he is telling the kids that to answer why they dont have a car. he has told thiem this same story last time it was repoed. him having his car repoed would be a huge factor aginst him saying he is financially stable. how can he afford to get his car fixed whick with out insurance will be a few thousand dollars and he has to get food from food banks

I’ve just turned 16 and I am pregnant. I want to move in with my boyfriend at his new apartment. He has two jobs and makes enough money to support us, but I also have a part time job. I’ve bought a car and I’ve paid for car insurance. I am ahead in high school and my plan is to obtain all of my required credits around April. Four years of my college will automatically be paid for by my Dad’s veteran disability benefits. My dad lives in Europe and he said that he would be okay with emancipation if his consent was needed. I am confident that my boyfriend and I can support our child on our own. The only problem is that I know that my mom won’t approve, especially when she finds out that I’m pregnant. When she finds out that I’m going to be having a baby she will want to try and make all my choices even more than she wants to now. If I don’t get out now and learn how to support myself before my child is born it will be a lot harder learning to support us at once. I’m sure that in court I would easily be able to be emancipated if only my mother would consent. Since she doesn’t I really don’t know how I should go about this. The laws for emancipation in the state of Alaska are •The child must be a resident of Alaska •The child has to be at least 16 years of age •The child must be living separate and apart from the parents or guardian •The child must be capable of supporting himself or herself financially and managing his or her own affairs •Each parent or guardian must consent (although there are certain exceptions) I don’t know how to go about this if I’m not already supporting myself for six months and living on my own. If I leave home my mom will call me in as a runaway. I’m assuming that the parental consent exceptions are something other than my case. On the form it really focuses on whether schooling is or will be finished, when it will be finished and how I will go about it. It asks about a job, which I already have and about my rent situation. There are also other financial questions, but I am not out on my own and able to answer these questions on the form. I’m just looking for any advice that I’m not already informed of. I want to know how someone else would go about this. I’m not going to give up on moving out and supporting myself and my child. Thank you so much for listening. My mom will always help me, but I need to learn to be responsible for myself as much as I am able. I want and answer about how I should go about the process. This is not to get away from my mom, it is to build my maturity and responsibility. In a family where I have and child I would rely on the father to be responsible, love me and be supportive. This is what I have in my boyfriend. I wouldn't be with someone without these qualities for as long as I have.

Ok My mother passed away. She left no will. There was no life insurance and now i have a house full of stuff and some money she left on a cashier's check. I have 2 brothers ages 19 an 24 but they both were under legal guardian of my mom because they have mental disabilities. I have no money for anything to take of this, so is it possible to cash the cashier's check to pay for the funeral and moving expenses and such. I called her bank and they said i could deposit it but at that point i would have no way of getting any money out of the account as she did not have a debit card. Please some advise would be great, i have no idea what im doing.

Salaries vary greatly depending on state, relative cost of living, and grade taught, salary for a teacher with a bachelor's degree being an estimated $32,000 in the early years of teaching, usually teachers will get an increase in their salary yearly. They are employed by contracts, some contracts may include long-term disability insurance, life insurance, emergency/personal leave and investment options, one of the highest incomes of a teacher is usually maximum of $42,000. The first years in teaching are said to be very tough since its not a high paid job considering you are barely coming fresh out of college, if you love Roman Noodles then the financial should be no problem since thats what you are gonna be eating for the next 4 years. Teaching has an extremely high level of Work-Related Stress or WRS abbreviated, the degree of this problem is becoming increasingly recognized and support systems are being put into place. Voting Question: Seeing a specialist to diagnose mental disability?

Hey all, I asked a question a few hours ago about my bf's sister's behavior being linked to autism. Everywhere I've been looking I've been told to go to a specialist. I got some fantastic on yahoo! answers, but now I want to know something else. I am 19, and my BF is 20. Does he have any legal or legitimate right to take his sister (who is now 17) to a specialist to perhaps get diagnosed with a mental disorder? His parents are unwilling to take her to a psychologist to get a diagnosis, even though she is ALREADY in a special ed program. They are convinced that she'll "grow out of it" on her own... even though they don't know what "IT" is. See where I'm coming from??? My BF and I are doing our own research to try to figure out if there's anything WE can do, even though I'm not related to her and my BF is not her parent or legal guardian. Is there anything that WE can do? Is it legal for him to take her to a specialist, and would health insurance pay for a screening?? Thanks!

Here is the scenario - My completely disabled husband passed away a few months ago and I think I need to re-think my insurance. I have two teenagers and a financially comfortable relative who will be their guardian in the event that I die. Currently I have lots of insurance due to my late husband's disability and the fact that he used to be an insurance agent. I have a 20 year term, and 30 year term, a policy through work, and a Universal Life policy - totalling well over $1M. I think this is excessive now and see no need for a "lifetime" policy since my dependants will be grown and gone in a few years. Also, it is the most expensive policy and I can invest the money in other ways. Opinions?

To clarify: I own Guardian own-occupation disability insurance, which was initiated in California. Given a recent income increase, I am eligible to exercise a rider to increase my disability coverage. Are my premiums going to go up a different amount if I increase my coverage through my agent in CA than if I increase it through a different agent, say, in Ohio? Are these riders and insurance premiums nationally uniform for personal disability insurance plans through Guardian?

Resolved Question: Does anyone know if it's possible to get life insurance for someone with a mental disability, similar to CP?

My brother has a disability similar to Cerebral Palsy and I am his guardian since our mom passed away. I have heard that most insurance companies wont cover him, but am wondering if anyone has been successful or knows of any companies that would cover him. Thank you.

Is this a good policy? My broker says it's better than Aflac because it's non-cancellable and lasts until I'm 65 should I need it. He said that as a white-collar professional, long-term disability ins is important for me which I can understand since I need to protect my income. He gave me a health questionnaire to fill out. I'm not totally comfortable filling it out - is it standard to fill one out and do a physical exam and bloodwork like they want? If I take this policy, does this long-term disability ins totally replace Aflac (I have a 6 month policy through my employer). Does it make a difference that my broker is a proponent of the Lifetime Economic Acceleration Process (LEAP), which I think is hooey (I know LEAP is a subsidiary of Guardan)? Aside from that his description of Guardian disability insurance makes it seem like a good choice among several (Met, NY, Std).

Resolved Question: Will auto insurance companies try to trick you in to settling your claim by signing a release for your child?

Am I giving up my rights to settle my own insurance claim if I settle my children's claim from the same accident by signing a parent's release and indemnity agreement?
